web magazine - you know of our nearly two year exposé on the arrest, prosecution
and sentencing of Brevard county child advocate - Dana Delaney Loyd. All of our
earlier articles are linked to the right of this web page. In August 2015 - Loyd - the chief editor of Brevard's Best News was arrested by the Brevard County Sheriff's Office under the charge of making a false call to the Florida Abuse Hotline. Loyd had published several articles covering the allegations between the parents (Tim Michaud / Aimee Michaud Casey)* of a pre-teen child. The child's mother alleges that her daughter reported to her - and to medical & non-Florida law enforcement professionals - that the father had sexually approached the child. Loyd eventually came to the belief that local Brevard County officials (Sheriff's office, State Attorney's office, and the Court) were systematically ignoring these allegations. Loyd's concerns were shared by several medical and non-local law enforcement officials - to include the FBI. (see our May 15, 2017 article for details and supportive documentation) Shortly after her arrest - the State Attorney's Office (SAO) offered her a pre-trial ("shut the fuck up") plea bargain whereas she would be required to self-censor and remove several of her web articles. This plea bargain can be reviewed within our December 3, 2015 article. From the very beginning we, VolusiaExposed.Com have maintained the opinion that Loyd's arrest - prosecution - AND now her sentence had little - to nothing - to do with an alleged false call to the Florida Abuse Hotline. We forward the opinion that Loyd is a victim of a government persecution - in retaliation for her web articles critical of several government officials / agencies - to include - but not limited to the Brevard Sheriff's Office, the State Attorney's Office and Circuit Court Judge Robin Lemonidis. |

Our Opinion We (VolusiaExposed) provide both the supportive evidence and argument to the above listed opinion - within our May 15, 2017 article. Loyd - seeing the plea bargain as an illegal attempt to censor her web articles - articles having no criminal connection to her alleged crime of making a false abuse hotline call - Loyd opted to go to trial. On March 30, 2017 - after a very "managed"** trial - Loyd was convicted. On April 6, 2017 - Judge Robin Lemonidis sentenced Loyd - to what we believe to be an illegal and self-serving sentence. Immediately after her conviction & sentencing (March 30 - April 6, 2017) - Loyd, with the assistance of her friends / peers, secured the representation of a Miami law firm to file her criminal appeal. After a detailed review of the trial court's transcripts - the law firm filed a motion alleging that Judge Lemonidis' sentence was an illegal sentence. As covered within our July 1, 2017 article - during a June 29, 2017 hearing - Judge Robin Lemonidis had to walk back many aspects of her illegal sentence. While the law firm saw the sentence as illegal - here at VolusiaExposed - we saw the sentence as both illegal and self-serving to Judge Lemonidis' apparent desire to have articles critical of her removed from Loyd's web magazine. Now with this most recent legal brief - Loyd's attorneys have argued that due to errors (or misconduct - our OPINION) by Judge Lemonidis and the prosecuting attorneys - Loyd did NOT receive a fair and impartial trial. We (VolusiaExposed.Com) STRONGLY agree. Since Loyd's August 2015 arrest - we (VolusiaExposed.Com) have published an Exposé series of articles detailing our belief that Loyd's arrest & prosecution were politically motivated - with the ultimate goal of silencing a media critic. Our Exposé further details numerous judicial conflicts of interest - that should have caused Judge Lemonidis to recuse herself. ------------------ *advisement - Within our pre-trial articles - we felt an obligation to redact - and / or not use the identities (names) of either the father or the daughter attached to the Loyd prosecution. However, post trial - we (VolusiaExposed.Com) have re-evaluated our position in redacting these names. It is difficult for us to continue redacting these names - given the following factors. The father - Timothy Michaud testified during Loyd's PUBLIC trial - whereas his identity - and that of his daughter's - were clearly disclosed to the public. VolusiaExposed.Com has secured public records (court videos / transcripts, etc) whereas the Court has opted not to redact these identities from the official record. This is after - we were billed and paid for the records to be properly and legally redacted. Loyd has appealed her conviction to the 5th District Court Of Appeal - and those records incorporate the father's and daughter's identities. Further - during a March 27, 2017 hearing - Judge Robin Lemonidis threatened our representatives with six (6) month jail sentences for merely taking notes on the prospective jurors (see video - right of page ->). Shortly (within minutes) of Judge Lemonidis accusing our representatives of attempting to "thwart" the judicial process by memorializing the prospective jurors names in our press notes - thus threatening them with direct contempt of court jail sentence - the judge's clerk posted those very same prospective jurors names to the world wide web (court's website - BrevardClerk.us) - two days prior to the start of the trial. Therefore - given that the father's and daughter's identities are easily available within the Court's records - and / or on the Clerk of the Court's website - we feel our attempts to protect these identities have been "thwarted" by the Court. Lastly - VolusiaExposed.Com has NO opinion regarding the validity of any of the allegations regarding whether Timothy Michaud has engaged in an inappropriate relationship with his minor daughter. While - we acknowledge that several individuals - to include Loyd - have expressed their concerns regarding Mr. Michaud. Our CONCERN regarding this matter - solely centers on whether local officials have properly investigated these allegations. In our OPINION - these allegations have NOT been properly investigated. ----------------- |
