Last August 28th (2015), the Brevard County Sheriff Department arrested Dana Delaney Loyd, the Chief Editor of BrevardsBestNews.Com.

The BCSO charged Loyd with filing a false child abuse report and cyber-stalking.

To the credit of the local State Attorney's office (SAO) - they quickly dropped the cyber-stalking charge. However, to their discredit, and as detailed in our September 2015 article - the SAO has continued to prosecute Loyd for the charge of filing a false child abuse report - when they clearly lack the statutory required malicious intent, nor any of the apparent four elements of the alleged crime. (9) A person who knowingly and willfully makes a false report of child abuse, abandonment, or neglect, or who advises another to make a false report, is guilty of a felony of the third degree, punishable as provided in s. 775.082 or s. 775.083. Anyone making a report who is acting in good faith is immune from any liability under this subsection.

F.S. 39.01(27)
(27) “False report” means a report of abuse, neglect, or abandonment of a child to the central abuse hotline, which report is maliciously made for the purpose of:
(a) Harassing, embarrassing, or harming another person;
(b) Personal financial gain for the reporting person;
(c) Acquiring custody of a child; or
(d) Personal benefit for the reporting person in any other private dispute involving a child.

Can Someone Confirm That It Was The USA That Won The Cold War - And Not The Russkies?

VolusiaExposed.Com has recently obtained a December 29, 2015 prosecutor's (SA) motion to the court - in which the prosecutor apparently desires the court to declare the entire Loyd court file as confidential.

Additional records (scroll down to review) support that in September and December the State Attorney requested that the Clerk of the Court not release certain records to the public - given that the State Attorney (SA) held the position that the records were of a confidential nature. Both times - the Clerk of the Court REFUSED the SA's request to reclassify the records from public access to confidential.

It would appear that since the SA could not get the local Clerk of the Court to re-classify the court file as "confidential", he decided to finally ask a judge to do so. The SA has a pending court hearing later this week - in which they (SA) desires that the assigned judge grant a confidential status to Loyd's court file.

While VolusiaExposed understands that there are logical, reasonable and legal reasons to redact certain information from court files - two things come to our immediate thoughts. First - wouldn't the Clerk of the Court be keenly aware of what circumstances required such redactments - and second - can there really be a legitimate rationale to redact an entire court file?

The last we checked the 6th Amendment to the U.S. Constitution grants all criminal defendants a fair & public trial. We are left wondering how Loyd can receive a fair & public trial - if public documents are barred from the public's view? Then again - no one should be surprised that this is apparently occurring in Brevard County - as it has a recent history of not honoring the 6th Amendment - just ask recently removed Brevard County Judge John C. Murphy. (More on this - later in the article)

Some Recent Examples Of Brevard County Scandals?

Judge John C. Murphy - Violating The Sixth Amendment

Well - how about the recent removal by the Florida Supreme Court of Brevard County Court Judge John C. Murphy?

Judge Murphy was recently removed from the bench - due to his connections to allegations, that he had circumvented the 6th Amendment rights of criminal defendants (right to legal representation / speedy trial).

QUESTION: Ever wonder why the Assistant State Attorneys in Judge Murphy's courtroom did not put a stop, or at the very least, question Murphy's violations of the 6th Amendment?

Loyd is now being prosecuted by this very same State Attorney's office.

Former Brevard Deputy Ryan Pill - Sex With Minors

According to a local television media outlet - former police officer & Brevard Deputy - Ryan Pill was arrested in May 2014 for engaging in a sexual relationship with an underage girl.

But that is NOT the shocker here - rather the shocker is - that Loyd's BrevardBestNews.Com had been publishing articles regarding Deputy Pill's sexual indiscretions for at least six months prior to his arrest.

In fact - in December 2013 - VolusiaExposed.Com published an article in which we congratulated Loyd for exposing the corruption within several Brevard County law enforcement agencies - attached to former Deputy Pill's sexual misconduct. Today - VolusiaExposed holds the opinion, that absent Loyd's investigative journalism - Deputy Pill would have never been arrested in May 2014. Obviously - her actions of exposing both Pill's and the agencies' misconduct - did not endear Loyd to several local law enforcement agencies - to include the Brevard County Sheriff Department and the State Attorney's office.

VolusiaExposed holds the OPINION that Loyd's investigative journalism in the Ryan Pill matter was the catalyst to her becoming a retaliatory target of both the Brevard County Sheriff's office and the Office of the State Attorney.

UnChecked Child Abuse With Brevard County

The attached media article (click picture ->) speaks to the child abuses that have fallen through the current cracks within the Brevard County criminal justice system.

Loyd has been a long time messenger of how the system is failing to protect Brevard's children. Brevard's officials have apparently decided to employ an ancient Greek response to Loyd's message - they have decided to kill the messenger's message.

Given that Loyd was on target with the Deputy Pill misconduct - and given Brevard county recent past history of mishandling major cases of child abuse - is it really to the benefit of Brevard's children to prosecute one of their most ardent advocates?

The Arrest Of Photo Journalist Jeff Gray
The Precursor To The Dana Delaney Loyd Arrest

In October 2013 - Photojournalist Jeffrey Gray was arrested by Brevard County sheriff deputies for what amounted to video recording a traffic stop.

Apparently the BCSO didn't appreciate being video recorded. It would seem that those pesky unauthorized (but legal) videos can be very damning to law enforcement agencies - just ask the following police agencies - Ferguson, Mo. PD - Baltimore Md PD - Chicago, Il PD, as well as many other police departments across this nation.

Eventually - the SA had to drop the charges against Gray - stating that they believed that Gray's actions were illegal - but they did not believe that they could secure a conviction. In short, and in our OPINION Gray's arrest was nothing more than a harrassment arrest.

We (VolusiaExposed) believe that the arrest and prosecution of Loyd is of a similar nature. The police don't appreciate Loyd's critical website - anymore than Gray's video camera.

A word of advice for anyone critical of the BCSO - always have a bondsman on standby and on speed dial.

Loyd's Allegations

So - do we (VolusiaExposed.Com) share Loyd's belief that the BCSO and SA has failed to properly investigate alleged sexual child abuse?

Yes we do !

Further, we have confidence in Loyd's ability to recognize child abuse. In short - Loyd's record of successfully identifying a sexual abuser of children, in our opinion, seems to out shine that of several local law enforcement agencies.

But here is a chance for you to decide for yourself - to the right of this page is the BCSO and a North Carolina investigation on the same father and the same child. This is the alleged abuser Loyd was reporting when she was arrested for filing a false abuse report. After reading the North Carolina report - would you too have been compelled to pick up the phone?
