In The Defense Of Dana DeLaney Loyd Has The Brevard County Sheriff Department Over Reached In Their Arrest Of Loyd? |

VolusiaExposed.Com has for the most part, focused our engeries on exposing government corruption within Volusia County. However, the recent arrest of BrevardsBestNews.Com Editor, Dana Delaney Loyd demands that we take up the fight to expose the corruption surrounding her arrest. In our opinion, Loyd's criminal prosecution is being guided by several political & personal desires within the Brevard County Sheriff Office (BCSO). Loyd has constantly exposed both the corruption and the weaknesses that exist in the local criminal justice sytem, including that part of the system, that insures the health and safety of our children. |

Marc Kovacs', a writer for BrevardsBestNews.Com (BBN), recent article does a excellent job detailing the on going witch hunt against Loyd by Brevard County officials. Kovacs' article is of particular significance, given his many years of law enforcement experience. Kovacs is correct in his assessment, that Loyd is a "staunch advocate of justice". Her articles exposing corruption within the Brevard County jail, and the questionable practices of at least one local judge, stand as testament to her devotion of "justice". Loyd's biggest passion is for insuring the safety of children. The children of Brevard County are indeed in need of advocates like Dana Delaney Loyd, especially when a local judge has stated that he sees nothing wrong with a "little pedophilia" (Click here - 2001 Orlando Sentinel Article). |

According to a March 2014 media article (ALJAZEERA.COM), not only have there been failures within Brevard's judicial chambers - but the Florida Department of Children and Families (DCF) has also suffered their own deadly failures. Just imagine the embarassment and liability that attached to these government agencies when these scandals were and are uncovered by media outlets. In Florida - judges, sheriffs, and yes, even the state attorneys are all politicians. However, not only are they politicans, they all have law enforcement powers - and in our opinion, these powers are routinely misused for political gain. Most politicians would not even consider taking on a high profile investigative reporter from one of the major news outlets (CNN, FOXNEWS, Orlando Sentinel, etc). The question appears to be - Does the BCSO see Loyd as an investigative journalist? We (VolusiaExposed.Com) submit that their (BCSO) media release on Loyd's arrest (see below) contains the answer to that very question. (More on this, later in this article) |

The BCSO Has Over Reached In Attempting To Silence An Investigative Reporter On August 28, 2015 - Loyd was arrested by the BCSO for alleged violations of Florida criminal statutes 39.205.9 - Filing a False Abuse Report & 784.048.2 - Cyberstalking. While no one here at VolusiaExposed.Com has a law degree - our simple review of the criminal statutes does not appear to support that Loyd's actions contained any criminal violations. |

First, what is a "false" abuse report? Many of us "think" we know what a false report is - but how does Florida Criminal Statutes define it?
Fortuately for Loyd, F.S. 39.01(27) clearly defines what must exist for there to be a viable violation of F.S. 39.205.9 From our reading of the statute - Loyd would have had to "maliciously" make the report, in an effort to either harass another person, to gain a personal / financial benefit or to acquire custody of a child. |

Obviously, Loyd had no personal or financial benefit in the particular child custody issue, nor was she attempting to gain custody of the child.
It would appear that by the filing of the 784.048.2 - cyberstalking charge, the BCSO has formed the opinion that Loyd filed the alleged false report to be "maliciously harassing" to the alleged victim. However, it now becomes necessary to find, and review the statutory definition of "cyberstalking" |

Again, it is fortunate for Loyd that
F.S. 784.048.1 provides a definition of what equates to the crime of cyberstalking.
The criminal statute provides an exemption from a cyberstalking charge for "legitimate purposes" and "constitutionally protected activities". We invite you to read the BCSO's own press release (below right of page) regarding Loyd's arrest. In our opinion, the BCSO press release gives clear indication that Loyd's actions were guided by her desire to forward her journalist agenda within her online publication, BrevardsBestNews.Com. Also, it is of investigative significance to realize that the BCSO has in the past assisted Loyd (arranging interview(s) with BCSO staff) regarding her journalistic agenda. Therefore, both facts (BCSO press release & past history of assisting Loyd) provides us with the evidence needed to conclude, that the BCSO should have concluded that Loyds' actions regarding the abuse report were LEGITIMATE and PROTECTED by the First Amendment to the U.S. Constitution |

In fairness to the BCSO - VolusiaExposed.Com sent BCSO Major Tod Goodyear a September 4, 2015 email, in which we expressed our views and concerns regarding their arrest of Loyd. As of the publication date of this article (September 12, 2015) no response to our email has been received. Therefore, as listed in our email - it is our OPINION that Loyd was not arrested for any violation of Florida Statutes - but rather, Loyd's arrest was a political retalitory strike, conducted to silence her criticisms against the Brevard County judicial system, with particular attention given to the BCSO. In the end - we suspect that the BCSO see Loyd as just another girl with a blog. Knowing what we know of Loyd - the BCSO is about to be schooled by an investigative journalist, known as Dana Delaney "Just A Girl" Loyd. Dana - YOU GO GIRL !! - you have our support !!
