The DeLand PD was able to publicly present their version of events within their DPD Internal Affairs report. Therefore, this publication decided that we had an obligation to collect and publish Officer Goins' counter argument - as given within his two day employee arbitration hearing. ==>>

We have attached the two days of hearing video records for public review. ==>>

In the particular - these videos were posted for the benefit of other DeLand police officers - so that they may decide for themselves - whether they have the honest support of their police chief, and - IF necessary - whether their agency's internal affairs division will afford them a fair and impartial investigative review (within the confines of Florida State Statutes / Laws).

During our attendance at this arbitration hearing - this publication came to the OPINION that the DPD failed to honor Florida statutes regarding the manner in which they conducted their internal investigation - thereby denying both officers (Goins & LaFleur) their due process rights. In addition - there is credible evidence that suggests that member(s) of the DPD administration knowingly injected falsifications, and / or manipulative practices into the investigative process and conclusions.

Officer Goins' termination is currently under the review of a labor arbitrator. Once that process has been completed (March-April 2022) - we anticipate doing an in-depth review of their terminations (Goins & LaFleur).

ADDITIONAL BACKGROUND INFORMATION

While both Officer Goins & LaFleur were rookie officers - both on probationary employment status - thus having no termination appeal rights - the DPD failed to take disciplinary action against Goins prior to him completing his probationary period. Therefore, the police union was able to come to the defense of Officer Goins - in the form of appealing Goins' termination via requesting a hearing in front of an labor relations arbitrator.

We have come to the OPINION that while rookie Officers Goins and LaFleur could have done a better job handling the arrest - they did not lie in their reports, nor did they with malice violate the arrestee's constitutional rights.

This publication has concerns that members of the DeLand PD conspired to create a false narrative against both Goins & LaFleur - and knowingly violated their constitutional and statutory due process rights (F.S. 112.531-112.535) - given to law enforcement officers under investigation. We would argue that members of the DPD openly admitted to these due process violations within their arbitration hearing testimonies.

We suspect (Our OPINION) that this false narrative "conspiracy" against Goins & LaFleur was forwarded in order to provide an influential citizen with some legal coverage for his criminal conduct.

The Arrest Of Joseph Stapf:
Honesty Has Consequences


In the early morning hours of January 20, 2019 rookie DeLand (FL) police officers Lesley Goins and Austin LaFleur were engaged in patrolling the streets of downtown DeLand.

Officer LaFleur had answered a call for service at a local downtown bar and grill - regarding a belligerent patron (later identified as Joseph Stapf). Officer Goins was proceeding in his patrol car to the bar's location as Officer LaFleur's back up.

As is detailed within a DeLand PD (DPD) internal affairs report - as Officer Goins was arriving on scene - he believed he saw a scuffle between Officer LaFleur and Stapf. Goins also observed LaFleur handcuffing Staph.

In accordance with DPD transport policy, and believing that Stapf was in custody - Officer Goins searched Stapf - finding him in possession of cocaine. According to the arrest report, Stapf was arrested for possession of cocaine, resisting arrest, and disorderly conduct.

Clerk of the Court records indicate that on February 7, 2019 - the State Attorney dropped their criminal prosecution of Stapf. (stand by - this becomes a consistent theme regarding Stapf's multiple arrests)

According to the internal affairs (IA) report, as well as both Police Chief Jason D. Umberger's and IA Investigator Lt. Millan's testimonies at Officer Goins' December 2021 arbitration hearing (see right of page for arbitration hearing videos) - Umberger & Millan allege that Goins and LaFleur had no probable cause to search, or to arrest Stapf.

Chief Umberger then ups the ante - by alleging that Goins and LaFleur falsified their arrest reports on Stapf. (supported by Lt. Millan)

Evidence & hearing testimony supports that Lt. Millan initially cleared both Goins & LaFleur of any misconduct. However - Lt. Millan changed his initial investigative conclusions after receiving "guidance" from the DPD's administration. (The proverbial "BUS" just backed over both Officer Goins & LaFleur)

Joseph Stapf's Background


According to Volusia County court records (see right of page), Stapf has a remarkable arrest history - dealing with battery, and refusing to leave drinking establishments.

According to a March 2016 arrest report, Stapf was arrested by the Daytona Beach PD (DBPD) for trespassing when he refused to leave a Main street bar.

Court records indicate that this DBPD arrest was also abandoned by prosecutors.

A check with the Volusia Clerk of Court website will also reveal that Stapf's two 2008 criminal prosecutions for "battery" were also dismissed by the State Attorney's office. (Things that make you go hmmm !)

Why has the State Attorney always opted not to prosecute Stapf? We have a theory - it's our two tiered criminal justice system theory in action - read on for particulars.

Florida's Two Tiered
Criminal Justice System



This publication has argued in the past - that Florida has a "secretive" two tiered criminal justice system. This second tier justice system exist primarily to provide influential persons a "get out of jail free card".

This "secretive" justice system is also occasionally used to "prosecute" politically troublesome persons. (more on this shortly)

We suspect that given Stapf's financial connections with a Sanford gym (see upper right of page) - that he has some influential friends (we refer to these "friends" as "Peter Rabbits") assuring his criminal indiscretions are quietly transferred into this "secretive" second tier justice system.

The "cost" of saving Stapf from his own criminal indiscretions was paid with the sacrificial terminations of two rookie police officers (Our OPINION).

The 2018 and 2021 arrests and sentencings of Colton Phillips provide convincing evidence that this second tier justice system is alive and well within Volusia County - including the sealing of criminal records for those influential few. (Read the attached DBNJ article for particulars)

Brevard's Second Tier
Criminal Justice System



Brevard County has the second tier justice system down to a fine art.

This publication is of the OPINION that the local state attorney (Phil Archer - Brevard & Seminole counties) is currently using this "secretive" justice system to prosecute a known critic of Brevard County Sheriff Wayne Ivey - Mrs. Gregory (Kathleen) Edwards ==>>.

In December 2018 - Kathleen's husband - U.S. combat veteran Gregory Edwards died in the custody of the Brevard County jail. Many suspect that Edwards' death was attached to an excessive use of force action by members of the Brevard County Sheriff's Office (BCSO).

A veteran died in a Florida jail. Two years later, video shows he was tased, left convulsing in a cell.




Initially - Brevard Sheriff Wayne Ivey refused to release the jail video regarding Edwards' death. FloridaToday.Com, a local newspaper - successfully sued Sheriff Ivey for the release of the jail video.

Kathleen Edwards filed a lawsuit against the BCSO in reference to her husband's in-custody death, including the lack of timely medical treatment.

In July 2020, another tragedy struck the Edwards family - Kathleen's eighteen month old son (Gregory Jr.) died in an accidental pool drowning incident (as determined by the medical examiner - click here - see pages 54-55 of BCSO's own investigative report)

BCSO's Investigative Report

In March 2021 (nine months after the child's drowning, and shortly after Sheriff Ivey was forced to release the jail video) the BCSO, along with the State Attorney's office filed criminal charges against Mrs. Edwards regarding her son's accidential drowning. ====>>>

This publication suspects that State Attorney Phil Archer maliciously filed the criminal charges against Mrs. Edwards in retaliation for Edwards filing her lawsuit against the BCSO - and in response for Edwards questioning why the State Attorney's Office (SAO) refused to file criminal charges against jail deputies regarding her husband's in-custody death. (The Gregory Edwards' in-custody death was covered by several local, national and international media outlets)

As per our April 4, 2021 "Open Letter" to both Sheriff Ivey & SA Archer - it became clear to us - that similar child drownings within Brevard County - did not result in charges being filed against the child's parents / caretaker.

We allege (Our OPINION) that Mrs. Edwards is a victim of the Brevard County second tier justice system. That the sole purpose of Edwards' criminal prosecution is to provide some political retribution against a troublesome political critic.

The Hidden Homicide Of Passion Lucas
Facts Should Matter


If you are still doubtful of whether Brevard County employs a second tier justice system - the homicide of Passion Lucas - mother of six should convince you differently.

As is laid out within our February 26, 2022 article - in the early morning pre-dawn hours of June 20, 2021 - Suzanna Norris was driving drunk (available evidence (police report) supports over twice the legal blood alcohol level) on the back roads of Cocoa, Florida.

Norris struck and killed Passion Lucas - and according to the police report - Norris initially left the scene of the accident (a crime in of itself).

Cocoa PD took over six (6) months to criminally charge Norris - and only did so - after the circumstances of Lucas' death came to the attention of the news media (see below video of Attorney Jennifer Travis (Lucas family attorney) for additional details).

Attorney refutes claims of special treatment for driver in fatal DUI crash




After initially charging Norris with DUI manslaughter - State Attorney (SA) Phil Archer decided to drop the felony DUI manslaughter charge against Norris - stating that an "expert witness" had provided a "report" (click here to read) that was used to falsely manufacture (Our OPINION) the conclusion that Lucas was responsible for her own death. (see our above linked February 26, 2022 article for particulars)

The SAO is still currently prosecuting Norris for the misdemeanor charge of DUI. However, this publication suspects that this DUI charge will be plead down to a much lower traffic offense.

On February 24, 2022 this publication sent the SAO, as well as the forensic reporting firm an email (click here to read email) in which we expressed some concerns regarding the factual veracity of the forensic report. VolusiaExposed.Com has not received a response from either party (SAO / forensic firm).

Recently, a Brevard County judge ruled (click here to read ruling) that since the SAO has concluded that Norris' intoxicated state did not cause or contribute to Lucas' death - therefore Lucas' family members can NOT be legally recognized as "crime victims".

This publication would argue that the entire Lucas family are not only victims of Norris' decision to drive intoxicated - the entire family has also been victimized by the SAO - by them providing Norris with sanctuary from prosecution within this secretive second tier justice system (Our OPINION).

The Lucas family is represented by local attorney Jessica Travis. Per Travis' video account (see below video) - she has secured her own expert witness - whom after making corrections to some documented factual errors within the first "expert witness'" report - have concluded that a driver not affect by alcohol intoxication - could have avoided striking and killing Lucas.

The SAO is currently reviewing Travis' expert witness' report. This additional forensic report has not yet been obtained by VolusiaExposed.Com. (stand by to stand by - this report will surely become available shortly)
