On February 6, 2020, VolusiaExposed.Com attended and video recorded the eighteenth (18th) judicial nominating commission's (JNC) interviews of sixteen (16) judicial applicants.

This judicial opening was caused by Circuit Judge James Earp's retirement.

The JNC forwarded the names of six (6) judicial nominees to Governor Ron DeSantis. Within the next sixty (60) days, Governor DeSantis will appoint one of the six to the open judicial office.

Our OPINION Regarding The "Honorable" Michelle Naberhaus


Brevard County Court Judge Michelle Naberhaus interviewed, and again, made the JNC's "shortlist" for possible gubernatorial appointment.

As per our October 8, 2018 article, this publication is of the OPINION that the "Honorable" Judge Michelle Naberhaus, was less than "honorable" regarding her participation in an August 2018 political rally. (see below picture)

We suspect that her participation in this political rally was in violation of Florida Judicial Canons. Feel free to review our earlier article for the particulars on this subject, and then decide for yourself, whether Judge Naberhaus is "honorable" enough to sit on the bench within the 18th Judical Circuit?

Adding insult to injury to her apparent "political participation" misconduct, Judge Naberhaus' most recent JNC application (see page 32 - question #34) appears to be somewhat deceptive regarding circumstances, whereas, Naberhaus has had to recuse herself from certain court cases -->.

As is supported by a Motion For Judicial Recusal, as well as Judge Naberhaus' own January 2019 Order Of Judicial Recusal, Judge Naberhaus recused herself from the Michaud v. Casey 2004-DR-019706 * custody case.

* The Michaud v. Casey case is / was the catalyst for the criminal prosecution of news reporter, Dana Delaney Loyd. VolusiaExposed.Com has published over forty (40) articles, in which we express our OPINION, that Mrs. Loyd's prosecution was forwarded in order to COVER-UP the Eighteenth Circuit's failures to properly investigate allegations of the sexual abuse of a child. We are currently developing an article, that will explore our additional concerns, that the Eighteenth Circuit continues to harass Mrs. Loyd, AND has now expanded their harassment to include seeking the arrest and extradition of Mrs. Casey (click here to read court order) from her home state of South Carolina. Apparently, the Court wishes to hold Mrs. Casey in contempt of Court for her refusal to stop insisting that local authorities failed to properly investigate her daughter's sexual abuse allegations (click here to review allegations). In our OPINION, local Brevard officials desire to manipulate the criminal justice system in order to silence both Mrs. Loyd and Mrs. Casey, so that no one will continue to question whether local officials properly investigated a child's sexual abuse allegations. VolusiaExposed.Com holds NO OPINION on the veracity of the child's "allegations", however, we do STRONGLY maintain that the allegations (child's, AND the arrest of Loyd) were NOT handled within the confines of the law. We now also question the Court's actions against Mrs. Casey.


There is no indication that Judge Naberhaus "knew" either Mr. Michaud, or Mrs.Casey, as appears to be Naberhaus' documented rationale, for her judicial recusals. Rather, Naberhaus' recusal appears to center around this publication's coverage of Naberhaus, with particular attention to her perceived judicial misconduct, AND Mr. Michaud's insistence that Mrs. Casey has editorial influence with this publication. (see Casey's Motion for Recusal - for particulars --->)

In truth, this publication, along with another local publication, BrevardBusinessNews.Com (BBN), have publicly questioned whether the entire Eighteenth Judicial Circuit is a "criminal organization" (see page five (5) of any of BBN's recent editions) Mr. Michaud has alleged that Mrs. Casey also has influence with BBN, therefore, given Judge Naberhaus' recusal from the Michaud v. Casey case, this publication is left wondering if not all judges within the Eighteenth Judicial Circuit have a similiar judicial conflict of interest. This particular concern (circuit wide judicial bias) was further highlighted, within Judge Charles Crawford's comments during a December 2019 hearing, regarding the media's continuing interest in the Loyd prosecution (we anticipate posting more on this particular topic within our pending and developing article).

And "yes", Judge Crawford, our publication does have legitimate media interests within both the Loyd, and now the Casey matters. More on this, within our pending article.

As is indicated in the below Motion for Recusal, and the Order Of Recusal, Judge Naberhaus recused herself from this case - because, in short, our publication (VolusiaExposed.Com) had been critical of Judge Naberhaus' political involvement in U.S. Senator Rick Scott's election campaign. Mrs. Casey former spouse alleges that Casey has "connections" with VolusiaExposed.Com.

The Folly Of Political Patronage Within Judicial Appointments


It is folly to believe that ANY of Florida's twenty-eight (28) judicial nominating commissions have the best interests of most Floridians in mind, as they select judicial nominees.

In reality, political patronage appears to be the driving force behind the selection of judicial nominees, and in the end, judicial appointments.

Judge Naberhaus was appointed to the Brevard County bench** in May 2016, by then Governor Rick Scott.

** Currently Judge Naberhaus is seeking an appointment from County Court to Circuit Court


Was she the best qualified for the job? Well, according to her own judicial application (April 3, 2019) (see page 4 of application) she carried a C+ G.P.A in law school. Was that the best, that the local JNC, and then Governor Rick Scott could provide Brevard County at the time, a C+ judge?

Now, this C+ County Court judge, after engaging in what certainly appears to be violations of Judicial Canons, seeks an appointment up to the Circuit Court bench. Sadly, but with no surprise, the 18th JNC has given their blessing for her appointment.

We (VolusiaExposed.Com) suspect that Judge Naberhaus will gain Governor DeSantis' appointment from County Court to Circuit Court. Why, well because it provides the governor with two opportunities to afford political patronage - one in the appointment of Naberhaus to the circuit bench, and another in appointment of someone to replace her on the county court bench.

Upon her predicted appointment, Judge Naberhaus should blend in well within the 18th Judicial Circuit. The 18th Judicial Circuit is well known for it's allegations of judicial corruption - as was detailed within a November 22, 2014 Orlando Sentinel article.
