Attempted Homicide Charges Dropped Against Man Who Shot A Brevard Deputy

The Florida 5th District Court of Appeal recently over-turned Brevard Circuit Judge Robin "Railroad" Lemonidis' decision to deny John Derossett a "Stand Your Ground" defense. (see attached DCA Opinion -->)

As covered within a local media article, in August 2015, three members of the Brevard County Sheriff's Office (BCSO) decided that they were going to make an unwarranted arrest of an alleged prostitute (Mary Derossett), who they (BCSO) alleged was "working" within the confines of her uncle's Port St. John home (John Derossett).

When the three plain clothes deputies attempted to pull Mary out of the front door of the house, Mary screamed for her uncle John. Uncle John, apparently thinking that the three men were attempting to kidnap Mary, engaged the "deputies" in a gun battle. One deputy, Casey Smith was critically injured. Uncle John also received a gun shot wound, prior to being charged with three counts of attempted homicide on a law enforcement officer.

All involved recovered from their injuries.

Uncle John, however, spent the better part of the last five (5) years behind bars awaiting trial.

Brevard Sheriff Wayne Ivey initially, and still does, as of the writing of this article, maintain, that his three deputies acted appropriately.

However, after the BCSO was able to review Mary's "little black book" of client names - it became necessary for the BCSO to terminate the employment of two other deputies, that were not connected to the shooting, but were apparent "clients" of Mary "Cougar" Derossett.

But the embarassment for the BCSO didn't stop there. In February 2019, one of the three deputies (John Roberts) involved in the Derossett shooting was shot a total of three times, while off duty, in Jacksonville, Florida. The Georgia man that shot him was NOT charged, because Jacksonville authorities ruled the shooting as self defense, therefore, justifiable. According to a local media account, the Jacksonville shooting was the final straw in a long series of disciplinary actions against Deputy Roberts. Sheriff Wayne Ivey terminated Roberts' employment.

This publication is of the OPINION that Judge "Railroad" Lemonidis has been "carrying water" for Sheriff Wayne Ivey for sometime now, and that the Derossett case was a heavy lift, even for Old "Railroad" Lemonidis. In addition to the Derossett case, we suspect that Lemonidis provided Sheriff Ivey judicial coverage within the Skyler Francis and Dana Delaney Loyd prosecutions.

Recently, Old "Railroad" Lemonidis brought her own pound of shame to Brevard County, when the Florida Supreme Court took disciplinary action against her for judicial misconduct.

Recently, Old "Railroad" decided to do the right thing, by abandoning her 2020 bid for re-election. The rumor on the streets, is that she has been offered employment within the BCSO - carrying even more of Sheriff Ivey's water.

Congrats to Mr. Derossett - and stand by to stand by ... there is surely more horse shit to shovel out of the judicial stable of Brevard County............
