On November 15, 2022 - VolusiaExposed.Com attended a post-conviction hearing within courtroom #4 of the Titusville (FL) courthouse - in which Skyler Francis (29) sought to have his 2018 criminal conviction over-turned.

VolusiaExposed.Com video recorded the entire hearing as a service to the general public. (see below linked video)

This hearing was in response to a November 2021 motion filed with the Court (click here to review). (The 46 page motion is well worth your review - - SPECIAL NOTE: it took nearly a year from the filing of this motion - to having this hearing. WARNING: be prepared to lose any faith you have in the Brevard County criminal justice system)

While Francis' motion (commonly refer to as a 3.850 motion) requested that the Court grant him a new trial - due to him receiving ineffective trial counsel - the motion also exposed numerous acts of gross judicial misconduct by trial Judge Robin Lemonidis.

The trial attorney's ineffectiveness was directly related to Judge Lemonidis' judicial misconduct (read motion for particulars - click here).

In December 2018 - VolusiaExposed.Com sent and published our "OPEN LETTER" letter to the Florida Judicial Qualification Commission (click here to review) outlining our concerns regarding Judge Lemonidis' judicial misconduct during Francis' trial.

In early 2020, the Florida Supreme Court disciplined Lemonidis for her misconduct within the Francis prosecution. Shortly thereafter Lemonidis withdrew from her 2020 re-election campaign. (see below linked article)

Sadly - the corruption attached to the Francis prosecution is merely one of many examples of the malversation that still currently exists within Florida's Eighteenth Judicial Circuit (click here for more examples). (Once again - be prepared to lose any faith you have in the Brevard justice system)

Circuit Judge Tesha Ballou was originally scheduled to to preside over the recent Francis hearing. However - Circuit Judge John Galluzzo - a "visiting judge" from Seminole County - at the 11th hour - was assigned to preside over the hearing.

Last August (2022) - VolusiaExposed.Com sent and published an "OPEN LETTER" to the Eighteenth Judicial Circuit (click here to review) in which we expressed a concern that Judge Ballou may have a "conflict of interest" in being the assigned judge in the Francis matter.

Additionally, local scuttlebutt alleges that Brevard Sheriff Wayne Ivey is actively engaging in a intimidation campaign against members of the Brevard judiciary (see below related articles) - therefore, the apparent necessity of bringing in Judge Galluzzo from Seminole County to preside over this hearing.

Sheriff Deputies' Over-reached
Francis' 2016 Arrest


In January 2016 - two Brevard County sheriff (BCSO) deputies reported to a domestic disturbance call.

A nurse - that was working at a neighboring home had heard some arguing coming from the pool deck - so she reported her concerns to the police.

Records, and sources verify that both participants (Francis & and his then girl friend) spoke with both deputies over the pool's privacy fence - assuring the deputies that they were okay.

However, the deputies insisted that the couple exit the house and come speak with them.

Because the couple refused to exit the home - one of the deputies tore down a panel of the privacy fencing - and both deputies enter on to the pool deck of the home.

The deputies allege that upon their arrival to the pool deck - Francis committed battery against their persons. Others at the scene - expressed the "opinion" that the deputies received their self-inflicted injuries while taking down the fencing, and / or tripping and falling over pool decking furniture.

The BCSO arrest report (Click here to read) alleged that Francis had murdered the two deputies.

In reality - neither deputy received any fatal injuries - and their actual injuries COULD have been a result of their aggressive entry on to the pool deck.



No Police Body Cam Video


This publication is unable to determine whether Francis attacked the deputies as they alleged. The Francis jurors were also left to decide whom to believe - the defendant, and his family OR the deputies. So - why wasn't there any police body cam videos of this incident? The answer to that question is simple - Sheriff Wayne Ivey will NOT authorize body cameras. (see below linked media article - Sheriff Ivey says deputies will not wear body cameras)

Sheriff Ivey is probably well aware that police body cameras are routinely used as evidence in officer misconduct investigations. (see below right - body cam video from October 2022 of a Texas police officer shooting a seventeen (17) year old boy)

The Hearing & The Plea Deal
During the November 15, 2022 hearing - Francis opted to take the plea deal as offered by the State Attorney. His original fifteen (15) year prison sentence was reduced to six (6) years - together with his ten (10) years of probation being nullified. Given the time he has already served - it is anticipated that he will be released in early to mid 2023.

We imagine that Francis came to the realization - that given the Eighteenth Judicial Circuit's long history of corrupt practices (as discussed within the above web links) - that he would NEVER receive a fair trial.

Francis has a young family to get back to - so in the end - you do what is best for your family.... and so goes for what passes for justice within Brevard County, Florida.


Stand By To Stand By - We Anticipate More Shenanigans


Having an appreciation of just how corrupt the Brevard County justice system is - we anticipate that prior to Francis' release from prison - "the system" will attempt to file additional criminal charges against Francis - ie. - battery on a correctional officer - introduction of contraband into a correctional facility, etc...etc..etc.. so - stand by to stand by.......
