Recently, Florida's Ninth Circuit State Attorney's Office (SAO) (Orange & Osceola counties) added Osceola County Sheriff Marcos Lopez to their Brady List of police officers in response to some alleged integrity issues attached to a homicide investigation. (see below related media article for particulars) .

"In this instance, the sheriff's (Marco) public statements, particularly regarding the release of a confidential and sensitive photograph, raised concerns about consistency and truthfulness," a spokesperson for the state attorney's office said in a statement.

We (VolusiaExposed.Com) found it to be of significant interest, that the Ninth SAO labeled Osceola Sheriff Lopez as a "Brady Cop" merely based on his alleged lack of veracity within his "public statements" - AND NOT just his sworn statements. For us here at VolusiaExposed.Com this was a "game changer" - an elected sheriff was officially tagged as a "Brady Cop" based largely on his public statements.

In the recent past, some Florida judges have been rather tolerant of sheriffs that like to play loose with the truth - particularly within their public statements. (see below linked related article).

The "Brady List" - What Is It?


The Brady List has it's foundation within two U.S. Supreme Court decisions - Brady vs. Maryland 373 U.S. 83 (1963) AND Giglio vs. United States 405 U.S. 150 (1972).

In 1963, in the Brady decision - the U.S. Supreme Court ruled that criminal prosecutors had an obligation to turn over exculpatory evidence to defense attorneys. By 1972, in the Giglio decision - the U.S. Supreme Court expanded "Brady" by ruling that past misconduct by police officers equated to exculpatory evidence - requiring prosecutors to report such misconduct to defense attorneys via the "discovery process".

In short, criminal defendants have the right to know whether the police officer that arrested them have credibility issues. These same credibility problems could possibility be used by the defendant, to call into question, the officer's veracity within the defendant's arrest incident.

Honest prosecutors (emphasis added) will develop their internal "Brady List" in order to assist them in making legitimate charging decisions. Some prosecutors and law enforcement agencies refer to their "Brady Cops" as "Giglio Cops" - the two terms are interchangeable.

In actuality - most agencies prefer the term "Brady" over "Giglio" - because "Giglio" sounds too much like "Gigolo" - and who wants to be "Just A Gigolo" - sing it Dave ! ==>>

Does Volusia Sheriff Mike Chitwood Qualify As A "Brady Cop"?


If "inconsistent and untruthfulness" within public statements has become the new "bar" for identifying "Brady Cops", then this publication would encourage the Seventh Circuit's SAO to officially declare Volusia County Sheriff Michael Chitwood a "Brady Cop".

In June 2021 - Sheriff Chitwood incorrectly stated within a media briefing, that two children (12 and 14 years-old) were responsible for firing military rounds from a AK-47 rifle at his deputies (see below media article & YouTube video).

One Child's Fight For Freedom & Justice


The twelve year-old child was prosecuted in juvenile court - while the fourteen year-old child (Ms. Nicole Jackson) was "railroaded" through adult court.

The Volusia Sheriff's Office's (VSO) own investigative report completed after Chitwood's statements) concluded that the AK-47 military rifle was never fired during the incident (see page 3, last sentence - of the second to last paragraph of VSO's investigative report - click here).

Even an investigation conducted by the Florida Department of Law Enforcement (FDLE) loosely supported that the AK-47 rifle was never fired.

Please also review our email communication with FDLE- normally FDLE does not hesitate in filling our public record requests - in this matter, we detected a lot of governmental "foot dragging".

To our knowledge, Sheriff Chitwood has never personally recanted these false allegations against the children. In failing to recant these false allegations - Sheriff Chitwood's apparent "incorrect statement" transforms from an "incorrect statement" into a nefarious lie against the children.

The "Bonnie & Clyde" Sex Appeal


We opine that Sheriff Chitwood purposely opted not to correct his statement regarding the false AK-47 gun fire - because the military gun fire provided the incident with it's "Bonnie and Clyde" media sex appeal.

Based on the alleged military gun fire - many within the world-wide press dubbed the children as the new "Bonnie and Clyde". This expanding interest provided Sheriff Chitwood with the media attention that he so craves. (see below linked media examples)

The problem was - that Chitwood could never allow his lie to be exposed - either by his own admission, or by courtroom testimony. Chitwood had to live the lie - and Ms. Jackson had to be denied a trial.

The Kriegsman Factor


SPECIAL NOTE: Within the second paragraph of this FDLE investigation - please note as FDLE's Resident Agent in Charge Jason Kriegsman was the lead supervisor within this shooting investigation, as well as being attached to other significant investigations - that are now being challenged within the Courts. (more on this within pending articles)

Per an email communication (confirmation) with the SAO - this publication has confirmed that Kriegsman recently left his FDLE employment, and now is employed within our local Seventh SAO office - as their Deputy Chief investigator. This publication opines that Kriegsman's employments with FDLE and now with the SAO - has a high probability to create conflict of interests - whereas both "truth" and "justice" will become the victims of these conflicts.

Seventh SAO Does Not Maintain A "Brady List"


We submit - that the Seventh Circuit SAO will never declare Sheriff Chitwood as a "Brady Cop" - why, well for two reasons:

First, because they (SAO) engaged - in our opinion - in a conspiracy with Chitwood, the Court, and the public defender's office - to "railroad" the fourteen (14) year-old child (Ms. Nicole Jackson) through the justice system - violating her constitutional rights to due process, and sentencing her to a twenty (20) years in prison.

Plus, as per an email verification by the Seventh SAO office - they don't even maintain a "Brady list". Please remember - we have opined that ONLY HONEST PROSECUTORS will maintain a "Brady list".

So, unlike the Ninth Circuit SAO placing their sheriff (Lopez) on their Brady list - our local Seventh Circuit SAO can't add our sheriff, or any other corrupt law enforcement officer to their Brady list - because they simply do not maintain a Brady list.

It should come as no surprise - Sheriff Chitwood is not the only liar within the ranks of the VSO.

Last year (2024) - now former VSO Deputies Ryan Cason and Robert Mitchell were placed under separate internal affairs investigation - whereas both were determined to have provided false information.

Deputy Mitchell


According to his internal affairs (IA) final determination report - Deputy Mitchell yet again returned to his old hostile work environment tactics - even after being demoted from sergeant for similar transgressions.

Deputy Mitchell resigned while under investigation for several violations (see right of page) including harassment and lying. (see right of page & click here to read Mitchell's internal affairs report)

Deputy Cason


Deputy Ryan Cason also resigned while being investigated for "untruthful" statements regarding his mishandling of "found" property - a women's purse (see right of page & click here to read Cason's internal affairs report).

Additions To Our Brady List


Based on the fact that the Seventh SAO does not maintain a "Brady List" - some years ago this publication started to compile our own list of local Brady Cops

We have received several "kudos" from local defense attorneys for our development of this "Brady List".

Our "Brady List" should not be considered to be an exhaustive list of corrupt cops that patrol our neighborhoods - rather it's just a list of dirty cops that have come to our attention.

With that in mind, and as supported by the above linked documentation, together with the Ninth SAO's decision to add Sheriff Lopez to their Brady list - Deputies Mitchell and Cason, along with Volusia Sheriff Mike Chitwood shall become our newest additions to our Brady List.
