As detailed in media accounts, as well as in the below attached Volusia Sheriff Office's arrest report, Stephanie Cobb was arrested on February 28, 2012 under the charge of engaging in unlawful sexual activity with a minor, an apparent violation of F.S. 794.05

School Teacher / Spouse of a VCSO Investigator?

While media reports and the official VCSO arrest report detail that Mrs. Cobb was a Volusia County high school teacher, these information sources fail to address, that public records tend to support that Mrs. Cobb is the spouse of a VCSO investigator.

VolusiaExposed.Com was able to secure public records supporting the marriage of the Cobbs, as well as their on going divorce proceedings.

VolusiaExposed.Com has crossed referenced the personal information (birth dates, etc) attached to the marriage and divorce records, to the Cobbs' arrests and / or employment records. This research tends to support that VCSO Investigator, Brian Cobb and Stephanie Cobb are currently husband and wife. (February 1, 2013)

CONFLICT OF INTEREST?
Does the assignment of the VCSO as the criminal investigative agency in the Cobb arrest, endanger the veracity of the criminal prosecution?


Maybe, it really doesn't matter if there is or is not a conflict of interest in the VCSO being involved in Mrs. Cobb's criminal investigation.

Maybe it's more important, whether a perceived conflict of interest could be argued?





Could someone really make a rationale argument, that since Mr. Cobb is an investigator with the VCSO, that other investigators within the VCSO might allow personal biases to influence their professional outlook?

Ask yourself, did the VCSO initially and clearly admit that their suspect (Stephanie Cobb) was the spouse of Investigator Brian Cobb?

If not, why not?

If deceitfulness and / or untruthfulness are introduced early, should we at all be surprised, if either becomes the common element within the investigative process?

While an arrest would tend to suggest that the VCSO can overcome any possible perceived conflicts of interest attached to the Cobb investigation, an arrest is not a successful prosecution.

Many criminal prosecutions are hampered by simple mistakes made by the police. Recent local history has reminded us, that a conviction / prosecution can be endangered, simply by the failure of the police to properly "Mirandize" a suspect (Casey Anthony case).

Failing to properly maintain the "Chain of Custody" of evidence attached to a criminal prosecution, can also endanger a successful prosecution.

Life Imitating Art?

Many of us might even remember the 1990 movie, "Presumed Innocent", in which the character played by Harrison Ford was charged with murder. Ford's character was a law enforcement officer that had been framed by his wife, for the murder of his mistress.

A drinking glass containing Ford's fingerprints was a key piece of evidence against him. In the attached clip (see right of screen), Ford's police officer friend was able to secure the drinking glass out of the evidence room, prior to being taken off of the case due to a perceived conflict of interest.

Our point - sometimes a "mistake" is made with an agenda in mind.



In the movie, Ford's character eventually realizes that his wife was the one that murdered his mistress. However, in order to save his son the embarrassment of not having a mother, he assists her in covering up her murder.

Did this sort of thing happen here? Are there reasons to suspect, that there could be individuals within the VCSO covering up for the Cobbs? Could this be life imitating art?






The State Attorney's Co-investigation

According to the Stephanie Cobb arrest report, the local State Attorney's office assisted the VCSO in this criminal investigation. Therefore, could an argument be made, that given the SA's involvement, that the integrity of Cobb criminal investigation is beyond reproach?

Maybe, but then again the State Attorney office's involvement was rather light, and centered mainly on the interview of VCSO Investigator Cobb.

Further, according to past VCSO records, the local State Attorney has a documented history of dropping felony charge(s), in order to avoid attaching any embarrassment to the VCSO, or their deputies. The Cobbs' Divorce Proceeding

As mentioned earlier, the Cobbs are currently going through a divorce. We wonder how convenient it is for Mr. Cobb, that his wife is:

1. Being criminally investigated by his apparent peers.

2. That his wife is being criminally prosecution by a State Attorney office who has professed concerns about bringing embarrassment to either the VCSO or it's deputies.

3. That the very same Circuit Court judge (Grimes), that signed the search warrants in her criminal investigation, has also been assigned to her divorce case.

What do you think? Is Mrs. Cobb that proverbial fish in the barrel?

On page # 18, paragraph 3 of the Stephanie Cobb arrest report, Investigator Cobb appears to admit, that on December 13, 2011, shortly prior to her making a 911 call regarding the 16 year old juvenile, Stephanie called him requesting that he locate the juvenile's home telephone number.

Investigator Cobb had already stated that he apparently did not know the juvenile, therefore, is it reasonable, for us to question, whether Investigator Cobb searched a law enforcement data base for the requested phone number.

At a minimum, we would suspect, that such is a violation of VCSO policy - using a law enforcement data base for personal reasons.

A Criminal Law Violation
By A VCSO Administrator?


In Investigator Cobb's statement to law enforcement investigators (see pages 17-18 of arrest report), it appears clear that as late as mid December 2011, himself and Stephanie were still residing at the Orange City marital home.

However, on page # 18, paragraph 4 of the report, Investigator Cobb also appears to state, that shortly after the 911 incident, he was advised by his supervisor, that his wife was under criminal investigation. Due to not wanting to jeopardize his employment, he required Stephanie to vacate the marital home, until after the completion of the criminal investigation.

According to page # 9, paragraph 4 of the report, VCSO Investigators Ott and Seymour were assigned to investigate the case on December 15, 2011 - two days after the 911 call.

Further on page #11, paragraph 2 of the report, it would appear that on December 15, 2011 - both Investigator Ott and Seymour made contact with Stephanie Cobb, at her new residence of 217 Alexandra Wood Drive, DeBary, Florida. The report documents that Mrs. Cobb had not finished unpacking, from her recent move from the marital home.

The report further documents that Mrs. Cobb refused to speak to the investigators without her attorney being present.

Did Investigator Cobb's supervisor violate any laws by advising Investigator Cobb of the investigation against his wife? And did Investigator Cobb violate any laws by advising his wife of the investigation?

In a recent case out of the Flagler County Sheriff Department, a civilian FCSO employee was criminally charged with allegedly advising her son that the FCSO was investigating him. We invite you to review the charging report on the Flagler County case, and you can judge for yourself, whether the alleged actions of the FCSO civilian employee were similar to the alleged actions of Investigator Cobb and his supervisor.

An Independent Criminal Investigation
An Independent Prosecution


So, given the possibility that Investigator Cobb and his supervisor violated the law, and coupled with State Attorney's past documented history of dropping felony charges, in order to spare the VCSO and their deputies embarrassment, should the Cobb arrest have been independently investigated and prosecuted?

While Stephanie Cobb was not a member of the VCSO, her husband is an investigator with the agency. Therefore, it would appear that VCSO officials should have called in the FDLE to handle the investigation, and the State Attorney should have requested that the governor assign the prosecution to another judicial circuit. (OUR OPINION)

FDLE was called in to investigate the Officer Bobby Tameris case. Officer Tameris was a Volusia County Beach Patrol officer that was suspected of engaging in a sexual relation with a juvenile. Officer Tameris was NOT a member of the Volusia County Sheriff Department, but they (VCSO) were NOT assigned as the investigative agency, rather FDLE was called in - and apparently rightfully so, due to a perceived conflict of interest, since Tameris was a county employee.
