Well, Well, Well - here we go again -

yet another instance of "special strokes for special folks" coming out of the office of the State Attorney's office ?

The pages of VolusiaExposed are just full of examples of preferential treatment by the law enforcement community of certain ranking individuals. (Our opinion)

In April 2012 Mark Carper was apparently threatening his neighbors with a firearm. The Volusia County Sheriff department responded - at which time Carper threatened the deputies in similar fashion. Carper - barricaded within his home, held the VCSO off for several hours prior to the VCSO just packing up and leaving Carper to his own apparent desires, to be a threat to himself and his neighborhood. Three weeks later, Mr. Carper would eventually fulfil his threats of harm by shooting and killing his neighbor, Dominick Frangiamore before killing himself.

The Carper family is a known political contributor to Volusia County Sheriff Ben Johnson.

The February 2012 domestic violence incident involving Robert Kaiser also comes to mind. Kaiser is a member of the Kaiser automobile dealership dynasty. The Kaiser family is a larger political supporter and contributor of Sheriff Johnson.

Towards the end of 2012, and after the elections, the State Attorney's office dropped some serious domestic violence charges against Mr. Kaiser.

A recent check of the Volusia County Clerk of the Court on-line records will also support that Kaiser had another recent domestic violent incident, in which the court with held adjudication.


In May 2013, Patricia Marianetti made a false 911 call stating that someone was attempting to break into her high end beach side home.

In truth, Marianetti was attempting to goat the responding deputies into shooting her - a practice commonly referred to as "suicide-by-cop".

One of the responding deputies shot Marianetti after she pointed what the deputy thought was a long gun at him. Marianetti survived the shooting and the long gun turn out to be a pressure washer wand.

Because of the police shooting - both the VCSO and FDLE had to conduct extensive investigations.

No charges were filed against Marianetti.

However, and in contrast, Desarea Clark was arrested in October 2012 by the VCSO for abusing the 911 call system.

Ms. Clark, a young college student, had initially requested assistance from the VCSO due to her wallet being stolen.

Clark did not like the service she was receiving from the deputy - therefore she dialed 911 to advise his supervisors of her concerns - she was immediately arrested for abusing the 911 call system by the same deputy she was complaining about.

The Black And White Of It


So, let's review the "black and white" of it - Marianetti calls 911 and reports a false home break in - in order to commit suicide by cop - gets shot by a responding deputy, due to her threatening behaviors - causes the start of two major law enforcement investigations - and she is not criminally charged, apparently due to her mental health issues.

Clark on the other hand - a true victim of a crime - calls 911 to report her wallet stolen is eventually arrested for abusing the 911 system because she threatened the responding deputy with a formal complaint. Wow - apparently the pen (formal complaint) is actually mightier than the sword, the gun or pressure washer wand.

Oh wait a minute !! - Did you think when we said "black and white" that we might be making this a racial issue? Come on people - for us to do that there would have to be at least some evidence that our local law enforcement officers and criminal justice practitioners make judgements based on race. Do you see any evidence of that ?
