Written Policies to Be Developed
23 years too late?



According to the below settlement, the county admits no wrong in complying with the Americans With Disabilities Act (commonly refer to a ADA). However, the county has agreed to pay a $88,000 settlement and to develop written policies on how they will comply with Title II of the ADA.

Being that ADA has been in existence since 1990 (23 years), one would have imagined that the county would have already had fully developed such written policies.

Then again why should we be surprised, after all, at last check, the county jail had not development an internal affairs policy - a requirement of Florida law.

112.533 Receipt and processing of complaints.
(1)(a) Every law enforcement agency and correctional agency shall establish and put into operation a system for the receipt, investigation, and determination of complaints received by such agency from any person, which shall be the procedure for investigating a complaint against a law enforcement and correctional officer and for determining whether to proceed with disciplinary action or to file disciplinary charges, notwithstanding any other law or ordinance to the contrary.
