In mid-April 2026 - Volusia County Sheriff Michael Chitwood filed a civil lawsuit against two Special Event promoters (Aliyah Brooks & Brittany Plummer - click here to review lawsuit).

According to Sheriff Chitwood's lawsuit - both Ms. Brooks and Ms. Plummer had organized - via social media - a two week long unsanctioned (non-permitted) event on the Beach.

On April 27, 2026 - this publication sent Sheriff Chitwood (and others - both CC & BCC) an OPEN LETTER (see right of page linked copy ==>>) in which VolusiaExposed.Com outlined six concerns we had regarding Sheriff Chitwood's lawsuit.

One of our concerns was the assignment of Circuit Court Judge Mary G. Jolley to preside over this litigation - due to Judge Jolley's husband's (Tim Jolley) employment history with the Volusia Sheriff's Office. (Jolley was sent a copy of our OPEN LETTER)

On April 29, 2026 - just two days after publishing our OPEN LETTER - Judge Jolley self-recused herself from the case - citing "judicial economy" as her rational. Apparently, other parties (business owners ?) had also filed similar lawsuits against Brooks & Plummer - with these other lawsuits being assigned to Circuit Court Judge Dennis Craig (Division #31).

Judge Jolley's (Division #32) "judicial economy" argument is that all of these lawsuits against Brooks & Plummer should be assigned to the same judge - ie. Judge Craig. (see right of page - linked judicial order by Judge Jolley)

Obviously, this publication throws down the "bullshit flag" on to the field - and we OPINE, that Judge Jolley is keenly aware of her conflict of interest within Sheriff Chitwood's litigation against these two civil defendants - Jolley just doesn't want to acknowledge the conflict.

We opine our belief - that both Jolley AND Chitwood were comfortable with Jolley presiding over the sheriff's lawsuits - until this obvious conflict of interest was "exposed" by this publication.

Furthermore - there exist other concerns with Judge Craig's assignment to these lawsuits - with particular attention given to the ones involving Sheriff Chitwood.

Judge Craig's attachment to these civil lawsuits is of great concern - especially, when observed through the prism of the 2018 criminal prosecution of Colton Phillips. (more on this - shortly)

Both Sheriff Chitwood and Judge Craig are "colorful" characters within Florida's Seventh Judicial Circuit. As indicated within the below linked media articles - neither of them have a problem defining and calling out government corruption when they perceive it - BUT they will probably take issue with this publication calling them out.

Daytona Beach Attorney Aaron Delgado - the petitioning counselor of record in ALL of these lawsuits filed against Ms. Brooks and Ms. Plummer - also has a contentious history within the circuit.

In 2022, the Florida Bar placed Mr. Delgado's bar license in a two year probationary status following a federal investigation (click here for additional information).

In fairness to Mr. Delgado - the Florida Bar is not known as a bastion of honesty - they have been known "to go after" attorneys for little more than zealously advocating for their clients (see below linked example).

Did the federal allegations against Delgado have any merit? Who knows - our federal authorities' credibility is not what it use to be.

Is there a QUID PRO QUO on-going between the Sheriff Chitwood and Delgado - in which Delgado AND the Court are providing Chitwood with the ability to conduct a type of "lawfare" against these women - in exchange for past or future transgressions being forgiven? Who knows - given the questionable history of the Seventh Judicial Circuit - nothing would surprise us -- but in the end - our readers must form their own opinions.

A Common Thread Between Chitwood, Craig, and Delgado


In September 2018 the Volusia County Sheriff's Office arrested Phillips - the 22 year-old son of a very prominent local businessman on inter-state drug trafficking charges (click here to read the arrest report for a full appreciation of the scale of the drugs trafficked).

Phillips was arrested with two co-defendants.

By February 2019 - just a few months after Phillips' arrest - a "rumor" was circulating within the law enforcement community that the State Attorney was floating a plea bargain that would keep Phillips out of prison.

Court records indicate that Phillips was represented by local defense attorney Aaron Delgado, the very same attorney that now represents Sheriff Chitwood and several business owners in their lawsuits against these two special event promoters (Ms Brooks and Ms. Plummer).

On February 19, 2019 - Volusia County Sheriff Captain Brian Henderson sent Assistant State Attorney Daniel Jancha an email stating that Sheriff Chitwood supported a similar prison sentence for Phillips - as was allegedly dealt out to his co-defendants. (see email - upper right of page ===>>)

After-all - a prison sentence would have been appropriate since the arrest report indicated that Phillips was the apparent ring leader of "The Colton Phillips Drug Trafficking Organization" (see arrest report).

In the end - Sheriff Chitwood apparently softened his stance on Phillips receiving a prison sentence - election records tend to support that the Phillips family and several members of the State Attorney's office made political contributions to Sheriff Chitwood's re-election campaign. Some time later - Circuit Court Judge Dennis Craig sentenced young Phillips to only fifteen years of probation with adjudication of guilt being withheld. In actuality, Phillips co-defendants received similar plea deals - one receiving probation that she eventually violated and went to prison for, the other had his charges dropped - as he was deported back to Iran.

Given that Captain Henderson's email incorrectly implies that Phillips' co-defendants received prison sentences - this publication questions whether the primary purpose for the email was to encourage political contributions in order to garner the sheriff's agreement to any plea deals? In the end - money talks and BS walks - have any doubts - then re-read the email - money is mentioned (assets).

Judge Craig also ordered the Clerk of the Court to seal the entire Phillips' prosecution from public records. (highly unusual)

The Daytona Beach News-Journal successfully sued for the unsealing of Phillips' court file.

In August 2021 Phillips would, like one of his co-defendants, violate the terms of his probation.

As outlined within our above linked article, together with our recent article defending Circuit Judge Kathleen McNeilly from Sheriff Chitwood's social media attacks - Chitwood has a long history of coercing judges and prosecutors to his warped "sense of justice".

Instead of the State Attorney's Office and the Court acting as a "check and balance" regarding law enforcement over-reaches - they have - with few exceptions - kowtowed to Sheriff Chitwood's demands. The "good-old-boy" system is alive and well within the courthouses of Volusia County, Florida.

Given all of the above - together with the apparent fact that Sheriff Chitwood is attempting to have the local state attorney file criminal charges against Ms. Brooks and Ms. Plummer - they would be wise to request that these matters be transferred far outside of the Seventh Judicial Circuit (Volusia, Flagler, Putnam, and St. John's counties - recommend the Tampa Bay area).
