UPDATE January 2, 2011 -- VolusiaExposed.Com is pleased that Governor Crist did not select candidate Nancye Jones to fill the open judicial position. As outlined on this web page, we believe that candidate Jones has too many possible conflicts of interest to hold a judicial position within the Seventh Judicial Circuit.

However, VolusiaExposed.Com must acknowledge disappointment in JNC Chairman Voges decision to find the JNC complaint against JNC Commissioner Jolley as legally insufficient (see below media article). We believe that Chairman Voges decision was incorrect and possibly brings discredit to the entire JNC process. In a December 13, 2010 email / press release, Chairman Voges appears to state that he had completed an "investigation" into Commissioner Jolley's questionable actions.

Does it appear that by the mere fact that Chairman Voges admits that he did conduct an investigation into the complaint, that the complaint was legally sufficient? We invite our readers to review PAGE 6 of the JNC Rules which reads - "The (JNC) chairman shall investigate any complaint if the allegations are in WRITING, SIGNED by the complainant, and LEGALLY SUFFICIENT." (see below highlighted copy of the JNC Rules) If in fact, Chairman Voges believed the complaint to be legally insufficient, then the complaint as per apparent JNC rules, should have never been investigated.

UPDATE December 19, 2010 -- VolusiaExposed.Com December 15, 2010 email to Governor Crist again expressing our concerns about Candidate Jones' conflicts of interest within the Seventh Judicial Circuit. We strongly believe that Candidate Jones' conflicts of interest will be troublesome should she be selected to fill retiring Judge Kennedy's position. The credibilty of the court will hinge on whether there is even a mere perception of a corrupt process. Circuit Court Judge Piggotte realized this in 2007 when she restricted herself to hearing only civil cases due to a conflict of interest involving her husband's position within the State Attorney's office.

We wonder if the "fix" is already in? Is the whole JNC process, to include an independent selection by the governor, nothing more than a "dog and pony show" to conjole the public? We bring your attention to an October 2010 press release by the Seventh Judicial Circuit (see below link). Notice that whomever replaces Judge Kennedy, will be assigned to the juvenile dependency division. Question - is this to accommodate any judicial candidate that might have a similar conflict of interest as that of Judge Piggotte?

We are left wondering - will the Seventh Judicial Circuit be assigned two judges (Piggotte / Jones?) that can not hear criminal cases due to conflicts of interest? What will that do to the criminal case loads, judicial rotations, etc..etc? Do the Florida JNCs operate in a shadowy environment, whereas policial agendas play a higher role in deciding who will be our judges, over what is in the best public interest? Does all of this rob the Court of its credibility? Has the Court already lost its credibility?

Recently, two Daytona Beach police officers were acquitted on charges that they intentionally damaged a woman's mobile home. A jury did not acquit these officers, County Judge Beck acquitted them, outside the presence of the jury. Was this whole prosecution and trial a mere "dog and pony show" to conjole the public into believing that lady justice is still blind in the Seventh Judicial Circuit?

We note that in the above media article, the police union representation was very pleased with Judge Beck's decision. Interesting - apparently Candidate Jones has secured union support. Also of interest is the fact that one of the officers were represented by local attorney Mike Lambert. Mike Lambert is also a member of the Seventh Judicial Nominating Commission. County Judge Beck is also a short list candidate for retiring Judge Kennedy's position.

UPDATE December 19, 2010 -- JUDICIAL NOMINATING COMMISSION REVIEWED THE BELOW ATTACHED JNC COMPLAINT.
When it comes to our government officials - we here at VolusiaExposed.Com both demand and expect much, but more times than not, we are left wanting and disappointed in the performance of those we trust to follow and enforce our laws.

Well, Seventh Judicial Nominating Commission reviewed the JNC complaint as filed by some of our readers and as presented on VolusiaExposed.Com. Several mainstream media outlets attended the December 16, 2010 JNC meeting. As these main stream media articles become available, VolusiaExposed.Com will post them here for our readers to review. We believe that a strong independent media is an important part of ensuring that the public's best interest is not taken advantage of by over eager government officials. We thank the media outlets that did take the time to attend the JNC hearing and welcome any article they publish that ensures and defends the credibility of the judicial selection process.

After reviewing the above media article(s), VolusiaExposed.Com is pleasantly surprised that the JNC commissioners did acknowledge that they will most probably have to develop some "local" JNC rules to ensure that this type of incident does not transpire again. Therefore, we congratulate the JNC complainants, in at least achieving that small victory, that in the end will give the citizens of the Seventh Judicial Circuit a more credible judicial nominating process.

However, we were also left disappointed and sadden by some apparent negative deflections of the issue by some JNC Commissioners

Apparently at least one of the JNC members (Frank Gummey) thought it was productive to allege that some of the JNC complainants had a vendetta against Judicial Candidate Jones. In the particular, Mr. Gummey alleged that the complainant John Bandorf had been terminated from Volusia County employment for misconduct and that Candidate Jones had represented the county in the alleged Bandorf termination. Frankly, we are at a loss as to why Mr. Gummey spent so much time defending Candidate Jones. The filed JNC complaint alleged misconduct by JNC Commissioner Jolley, not misconduct by Candidate Jones. However, Mr. Bandorf did point out that in the past, Mr Gummey and Candidate Jones did work in the same legal offices (City of Daytona Beach and County of Volusia) and that Mr. Gummey might feel as though he had some duty in defending Candidate Jones.

Mr. Bandorf went on to respond that he had not been terminated for misconduct and that official FDLE and county records would reflect that his retirement / separation from county employment was without misconduct. Mr. Bandorf assured the JNC commission that no internal affairs investigation existed that would support that his departure from county employment was due to a sustained internal investigation. In fact, it is VolusiaExposed.Com understanding that not only was there no completed internal agency investigation supporting a misconduct finding against Mr. Bandorf, it would appear that the county had no policies and procedures in place to conduct such investigations, and apparently still does not as of this day.

Mr. Bandorf was apparently employed as a correctional officer within the Volusia County Division of Corrections. As in the ever developing VCSO Captain Osowski incident, Florida State Law mandates (Florida Statute 943.1395(5)) that any law enforcement or correctional officers suspected of engaging in misconduct shall be internally investigated by his / her employing agency. During the recent VCSO Captain Osowski situation, VCSO administrative staff stated on the public record that since Captain Osowski was retiring such would negate the need for VCSO to conduct the mandated internal agency investigation into his alleged misconduct. Since then, VCSO has responded in a December 14, 2010 email to VolusiaExposed.Com regarding our concerns that State Law does require that an internal agency investigation be conducted on the Osowski matter, regardless of his pending retirement. Within that email, VCSO clearly states that VolusiaExposed.Com is correct and that an internal investigation has been started on the Osowski matter. Therefore, if Bandorf was terminated for misconduct a sustained internal agency investigation should be available via public records.

VolusiaExposed.Com is now working on obtaining the Bandorf separation paperwork. We are also considering obtaining the Court Reporter Transcripts for the December 16, 2010 meeting - we request hearing from our readers to determine whether there is a large enough interest in these transcripts. When we receive the documents we will develop a web page that addresses Mr. Gummey's allegations against Mr. Bandorf.

UPDATE December 1, 2010 - Well the political machine appears to be working OVERTIME in attempting to get Assistant County Attorney Nancye Jones appointed to the bench.

As stated below, VolusiaExposed.Com had questioned for some time, whether it was a substantial conflict of interest for Volusia County Assistant County Attorney Mary Jolley to be part of the Seventh Judicial Circuit Nominating Commission (JNC). The conflict centered around the fact that both Nancye Jones and Mary Jolley worked in the same office (Volusia County Legal). Further, Jolley has been employed with Volusia County for only a short period (approx. 4 months), therefore she is probably still under a probationary employment status.

We here at VolusiaExposed.Com felt that such a substantial conflict would produce the fertile ground needed to breed political corruption within the JNC selection process.

A very recent (November 30, 2010) public record search has appearently confirmed our concerns.

We invite our readers to review a November 4th, 2010 email from Assistant County Attorney Mary Jolley's office email account. Does it appears that Jolley is requesting political / professional favors in order to secure Nancye Jones' judicial confirmation from the Governor's office? How convenient it is for Nancye Jones to apparently have Attorney Jolley's support both in and outside JNC chambers.

Is this how the Florida Judicial Nominating system is suppose to work? Can a JNC Commissioner cast a vote for the candidate and then PUBLICLY (remember the below email is public record, therefore is accessible by everyone) become that candidate's biggest cheerleader / supporter?

Since many are aware that Mary Jolley is a JNC commission member - will some assume that her public endorsement of Nancye Jones is a de-facto endorsement by the entire JNC. If so, we are left wondering how the 30+ other applicants for this judicial position would feel about that? We are thinking of "reaching out" to those former applicants and advising them of our concerns.

What significance is it that Tim Jolley and Mary Jolley were related? Well, Tim Jolley would be on the same VCSO Organizational chart as would be Nancye Jones' spouse, Major Robert Jones. (see above Organizational Chart). Volusia County Sheriff Ben Johnson has been VERY suportive on Nancye Jones' bid for this judicial position (see below - Johnson's Letter of Recommendation). One thing appears obivious, Nancye Jones has alot of support coming from the VCSO. However, Commissioner Jolley appears to state in her November 4th,2010 email, that her four month working relationship with Nancye is why she is recommending Nancye for the position. Come on, with only four months of working with someone, would anyone really know someone that well to recommend them for a judicial position? Could it be that Commissioner Jolley's support for Nancye has its influences elsewhere?

Apparently, Nancye Jones can seek the political endorsements of two labor unions while at work and using her county email. It would also appear that Mary Jolley can politically canvass support for her mentor, Nancye Jones while on duty. Lastly, if two Assistant County Attorneys have this much time on their hands - do we have too many attorneys on the county payroll?

SOUTH FLORIDA OFFERS US AN EXAMPLE



UPDATE November 24, 2010 - Although a "working relationship" between members of the judiciary and law enforcement is an essential component to the administration of justice, recent history has reminded us that TOO CLOSE of a relationship between them can lead to the miscarriage of justice.

The debacle in South Florida surrounding Judge Ana Gardiner is a prime example of why the interest of the public, in our opinion, is NEVER served when a judge has a personal relationship with ranking member(s) of the law enforcement community. We invite you to read the events and allegations surrounding the Judge Gardiner situation. After your review, we ask you to wonder if similiar problems would develop should Nancye Jones be appointed to the Judiciary within the 7th Judicial Circuit (actual or preceived violations)?

Volusia County has had it's fair share of high profile murder cases. In fact, Volusia County has recently been assigned to hear a murder case out of Flagler County.

Volusia County can ill afford a similar scandal as Broward County was exposed to under Judge Gardiner. Judge Gardiner apparently had allegations filed against her (by both the Florida Judicial Qualifications Commission and the Florida Bar) stating that she had improper personal communications with a State Prosecutor in reference to a murder trial. Assistant County Attorney Nancye Jones has apparently applied to be an nominee for the position of Circuit Court Judge. She has a interview scheduled with the Seventh Circuit Judicial Nominating Commission on October 20, 2010 in Courtroom #10, Volusia County Courthouse Annex, 125 East Orange Avenue, Daytona Beach, Florida. We have some concerns on whether Attorney Jones would make a good candidate for a judicial position. Please see below for the details of our concerns.

The public can attend the interviews, however, deliberations, which are held before and after each interview are closed to the public.

The above article also speaks about the importance of judicial duty rotations. After reading the above media article - ask yourself, how will Attorney Jones, if selected, be able to live up to Chief Judge J. Walsh's comments that, "these judicial rotations are routinely made to permit judges to become more familiar with different aspects of the law"? We believe that Nancye Jones' substantial conflicts of interest put her in the same boat as Judge Piggotte?

Back in November 2007, it came to the attention of the media (Daytona Beach News Journal), that apparently Judge Piggotte's husband was working part time for the Seventh Circuit's Office of the State Attorney. Apparently Judge Piggotte's husband was involved in assisting the State Attorney in the prosecution / investigation of some criminal cases and such created a substantial conflict of interest. Apparently in response to a pending JQC (Judicial Qualification Committee) complaint on a conflict of interest issue, Judge Piggotte removed herself from hearing any criminal cases. Judge Piggotte now apparently only hears civil cases. Because of this, in our opinion, the judicial rotation process within the Seventh Judicial Circuit has been adversely affected.

We have concerns that Nancye will find herself in the same position. Nancye's husband is a high ranking member of the Volusia County Sheriff Department. As the reader can see by the attached organizational chart of the VCSO, it appears the Major Robert Jones is in charge of the "Law Enforcement Services" branch of the VCSO. It appears that all the sheriff office districts report directly to him. Therefore it is hard for us to imagine that he would not have direct insider knowledge or participation in all arrests made by the VCSO. Will there be exparte communications within the Jones' household about pending / on going criminal cases? If so, will such place these criminal cases in jeopardy?

Also of significance is that Volusia County Sheriff Ben Johnson has in the past wrote letter(s) of recommendation for Nancye to the Judicial Nominating Committee. Don't these Volusia County officials see the apparent conflicts of interest should Nancye secure the judgeship? Then again maybe they welcome the "fruits" of this apparent conflict of interest? Are the taxpayers going to get stuck again with a second judge that can only hear civil cases? What is that going to do to the criminal case load? Is this going to improperly influence the State Attorney to make more plea bargains with criminals due to the lack of judges able to hear criminal cases? If you agree, we would ask that you express your opinions to the governing officials as listed below.






In a recent media account, it was alleged that a Florida Highway Patrol Officer was tired of people telling him that Sheriff Johnson was driving around under the influence. Question - If a person is inclined to drive around under the influence, would it help him / her to have a Circuit Court judge in their corner? Sheriff Johnson - please stop the above behavior - for your safety and ours - however, if you insist on continuing with this type of behavior, have a good attorney on stand by - or have a friend waiting on a bench.

Further, even if Major Jones would retire from the VCSO, Nancye has some serious connections / history with other Volusia law enforcement officers that in our opinion create substantial conflict of interest issues.

During her tenure as the VCSO legal counsel, she was apparently involved (whether directly or indirectly) in the defense of Captain Dale Anderson and Sgt. Mike Coffin when they were indicted over a U.S. Justice Department investigation into the VCSO. We ask you to read both of Sheriff Johnson's Letters of Recommendation (see above) - doesn't it appear that Attorney Jones is currently providing legal assistance to the VCSO?

We invite you to read the below media article that give some insight into these matters. We think it is of significance that Sgt. Mike Coffin is now the Director of the Volusia County Department of Public Protection (VCDPP). VCDPP has law enforcement divisions under its supervision - the Volusia County Beach Patrol and the County Jail. Further, VCDPP supervises the Volusia County Medical Examiner's office. Therefore should the VCSO (or any law enforcement agency) have a questionable death, the Volusia County Medical Examiner's Office will determine the manner of that death.

Will Nancye be able to seperate her loyalties to the VCSO and VCDPP from her judicial responsibilites should questionable practices be charged against these agencies?

In the above article Nancye Jones states that the deputies legal defense funds were apparently partially funded by the VCSO's confiscated drug money account. Interesting - while Mrs. Jones is using this money to pay for the legal defense of deputies - her husband was apparently one of the main deputies seizing these funds. Of further interest, it has been discovered that one of the Judicial Nominating members (JNC) is now apparently employed as an Volusia County Assistant Attorney. Mary G. Jolley was an Assistant Florida State Attorney General out of the Daytona office when she was appointed by the Governor in 2008 as a JNC member.

While we here at VolusiaExposed.Com understands that by the strict definition of the law, there might not be a substantial conflict of interest simply because Attorney Jolley and Attorney Jones work within the same legal office. (see attached Attorney General Opinion) It shall however be interesting whether this possible conflict is (or was in the past) disclosed to the entire commission. By disclosing it to the commission, it shall then be up to the commission to determine if a substantial conflict of interest exists.

Might supporting a senior employee getting promoted out of the office, open more career opportunities for lower ranking employees?

We invite our readers to review Canon 3 of the Florida State Code of Judicial Conduct (we stress section E of this Canon) - would Attorney Jones constantly be left justifying that she was complying with this Canon? We believe she would, every single time a VCSO / VCDPP arrest came up in front of her bench.

While we believe that Nancye Jones is more than qualified for a judicial postion - we strongly believe however, that her many substantial conflicts of interest within the Seventh Judicial Circuit should preclude her nomination within that circuit. Nancye Jones should be encourage to seek a position within the judiciary outside the Seventh Judicial Circuit.
