Given the social turmoil caused by recent events - such as, but sadly not limited to - the arrest and police killing of George Floyd, the police shooting & killing of Breonna Taylor, and the police beating death of Tyre Nichols - police officers - both locally and nationally are being reminded of what should be an obvious fact - that when enforcing the law - they must also stay within the law.
On October 23, 2020 - two Daytona Beach police officers failed to remain within the law - regarding their traffic stop of Kary Jarvis. (see police video for particulars -->)

On that day - the police were so far outside the law - apparently - according to local Circuit Court Judge Sandra Upchurch (see below right - Judge Upchurch's ruling) - Mr. Jarvis was within his rights to leave the scene of the traffic stop - as he dragged the two police officers some thirty (30) yards down the road.

In short - Judge Upchurch's ruling suppressed much of the prosecution's evidence in the Jarvis case - due to the fact that the two police officers violated Mr. Jarvis' fourth amendment right to unlawful search and seizure.

Without this evidence - the prosecution no longer had a prosecutable case against Mr. Jarvis.

Initially, the State Attorney appealed Judge Upchurch's ruling to the 5th District Court of Appeal - but shortly later they abandoned their appeal - and opted to drop their criminal prosecution of Mr. Jarvis.

Does It Have Standing In Other Cases?


Given the legal principle of stare decisis - Judge Upchurch's ruling in the Jarvis case - may have standing in the on-going criminal prosecution of Iyanna Rollins.

On July 18, 2022 - Ms. Rollins was arrested by Volusia Sheriff Sgt. Chad Weaver - in what we (VolusiaExposed.Com) have opined as both an illegal traffic stop & detainment. (see our below linked articles for further information)

of Port Orange Police Captain Kimberly Kilpatrick
Lying Is Used Both Ways By Law Enforcement


Soon this publication will be making a deep dive into the criminal activities of former Port Orange Police Captain Kimberly Kilpatrick.

Last year (2022) - the Florida Department of Law Enforcement (FDLE) finally arrested Kilpatrick for long known (click here to read arrest affidavit) - and we allege - her long hidden criminal acts (long hidden by Port Orange PD, State Attorney, the Court, and FDLE).

HOWEVER, like most things within our local criminal justice system - "justice" is not the primary concern of most of our criminal justice gatekeepers (police, state attorney, public defender, and the courts). Within Central Florida - if not the entire State of Florida - politics, fame and fortune always out paces "truth, justice and the American way".

Kilpatrick was criminally charged with the financial exploitation of a disabled Port Orange police detective. The detective lost his wife in a 2016 motorcycle accident, the same accident in which he suffered traumatic brain injury (see below linked article for additional details).

Prior to Kilpatrick's arrest - her own department sustained allegations (click here to read investigative findings), that she had improperly deleted public records - that may have provided evidence, in support of her criminal activities.
