Twelve individuals have applied to replace the judicial seat left open by Circuit Judge John Harris' appointment to the 5th District Court of Appeal.

The 18th Judicial Nominating Commission (JNC) will be meeting on October 5, 2018 to interview the twelve applicants.

The JNC will then send between three and six applicants' names to Governor Rick Scott so that he can make the judicial appointment.

Gubernatorial Judicial Appointments Are They In The Public's Best Interest?

It is noted that former Brevard Judge John C. Murphy has submitted his application for the judicial appointment. Judge Murphy was removed from the bench by the Florida Supreme Court after a 2014 incident whereas it was alleged that he physically beat a defense attorney for refusing to waive his clients' U.S. Constitutional right to a speedy trial.

After the alleged beat down - Judge Murphy then proceeded with the defendants' hearings without defense representation - yet another violation of the U.S. Constitution.

Judge Murphy received much support from some of his local judicial and legal peers. Circuit Judge Morgan Reinman testified in front of the Florida Judicial Qualifications Commission (JQC) - in which she laid much of the blame for the incident on the alleged behaviors of the defense attorney.

Judge John C. Murphy Goes Rogue

The JQC eventually recommended that Judge Murphy be allowed to remain on the bench - only suffering a 120 day suspension, $50,000 fine and a public reprimand.

Fortunately for the citizens of Florida - the Florida Supreme Court did NOT asccept the JQC's recommendations - and removed Judge Murphy from the bench.

It is our OPINION that JNCs are heavily influenced by their judicial and legal communities. Therefore, we anticipate that Mr. Murphy will have some, maybe even enough support - in having his name forwarded to the governor for reappointment to the bench.
