Judge Refuses To Extend Councilwoman's Protection Order Against Local Political Gadfly, Alvin Mortimer Sheriff Alleges That Mortimer is A "Lunatic", And Has Threatened Deputies |

As was covered within our April 4, 2020 article, Volusia County Councilwoman, Heather Post had requested that Circuit Judge Karen Foxman permanently extend a protection order against local political gadfly, Alvin Mortimer. On April 30, 2020, during an approximate forty (40) minute hearing (see courtroom videos- right of page -->), that was held in two parts, Judge Foxman declined granting Mrs. Post's motion to extend the protection order. Interestingly, at the start of the hearing, Post expressed a desire, that the Court restrict local media outlets from video recording the hearing. Judge Foxman denied Mrs. Post's request to restrict the media coverage. Over Personal Threat During Mr. Mortimer's statements, he admitted his belief, that Post actually sees him as a "threat" - but Mortimer insists, that he is merely a political threat, and NOT a personal threat to Post. Based on Mortimer's internet postings regarding Post, it is clear, he is not a political fan, but neither does he appear to be a physical threat to Post (OUR OPINION). While Mortimer does NOT appear to be a physical threat to either Sheriff Chitwood, or Councilwoman Post, Sheriff Chitwood's comments on the May 1, 2020 Mark Bernier radio show (starts around minute 26) may have placed Mortimer in physical danger. Chitwood referred to Mortimer (not by name) as a "whackjob" and a "lunatic" - further stating that Mortimer (again, not by name) has been on Post's property, and in the past has threatened deputies. Mortimer has denied being on Post's property, or that he ever threatened a deputy. The Mark Bernier Show, and Sheriff Chitwood carry alot of clout within the community. People listen, and many assume, that their comments (Bernier & Chitwood) are gospel. While this publication has not been able to confirm Sheriff Chitwood's allegations, that Mortimer has trespassed on Post's property, or that he has a history of threatening deputies, IF this information lacks any credibility, then Sheriff Chitwood may have unjustly painted a target on Mortimer's back. Anyone, to include sheriff deputies, in the earshot of Chitwood's statement on the Bernier Show, may feel justified in having their weapons in the "locked and loaded" position when dealing with Mr. Mortimer. In OUR OPINION, based solely on Sheriff Chitwood's comments on the Bernier Show, Mortimer could reasonably be just a mere trigger pull away from facing deadly force. Therefore, Mr. Mortimer's desire to wear body armor may in the end, not be the irrational idea of a lunatic, but the rational precautions of a political gadfly, who only wishes, to exercise his constitutional right to speak against his government. |
