Concerns Within The Port Orange PD |

For sometime now, this publication has been receiving information that the Port Orange Police Department (POPD) is ripe with corruption. While there have been several corruption allegations made against the POPD - one particular allegation caught our attention immediately - due to the complainants' internal connections with the POPD - AND given the nature of the allegations. According to the attached Florida Department of Law Enforcement (FDLE) investigative report, in 2018 POPD Sgt. Justin E. White filed a complaint with the Florida Attorney General alleging that POPD Captain Kimberly Kilpatrick had assisted in fraudulently changing the beneficiary regarding Detective Fouts' employee life insurance policy. Initially, Fouts was not expected to survive his injuries. The FDLE investigation did NOT sustain any criminal wrong doing by Captain Kilpatrick. News-Journalonline.Com October 4, 2018 Port Orange police captain cleared; chief calls forgery accusation 'rumor mongering' Apparently fearing retaliation for reporting his suspicions against Kilpatrick - Sgt. White filed a January 31, 2019 memorandum with then Port Orange Police Chief Thomas Grimaldi. Within this memo - Sgt. White documented his concerns of being retaliated against - and memorialized additional concerns against Captain Kilpatrick. In August 2019 - Cathleen White (Sgt. Justin White's spouse) would file her own complaint against Captain Kilpatrick. Due to the traffic & traction this article has been receiving - we have updated it to include the second part of FDLE Special Agent Chris Deardoff's investigative report. In addition - the Port Orange PD's own internal investigation on the Kilpatrick matter is now available. (see web links - upper right column ==>). Further, we have incorporated the audios files of the witness interviews that are associated with Deardoff's investigative report (see to the right & below of page). Within Deardoff's investigative report - he provided a short interview summary of each witness' testimony. However, after a careful review of these audio files - we have come to the "OPINION" that Deardoff's interview summaries failed to completely express the accusations, the evidence, and the testimonies of these witnesses. We invite our readers to compare Agent Deardoff's report, including his testimony summaries, against what the witnesses actually testified to. Decide for yourself - whether Deardoff's investigative report gave a full, fair, and accurate accounting of the facts, evidence, and allegations that were lodged against Captain Kilpatrick? In the end - the state attorney office (SAO) MAY have only READ, or was ONLY PROVIDED Deardoff's narrative, when they (SAO) concluded that no probable cause existed in order to criminally charge Kilpatrick. |

In November 2019 - in an apparent response to Cathleen White's follow-up complaint - FDLE issued a November 8, 2019 memorandum supporting FDLE's initial investigative conclusion that POPD Captain Kilpatick did not engage in financial crimes in the Fouts matter.

Within their November 2019 response - FDLE stated that:
"After a complete review of the investigation, Assistant State Attorney (ASA) Robin Hutcheson found insufficient evidence to support charges against Captain Kilpatrick. ASA Hutcheson also did not request any follow-up to be conducted by SA Deardoff. Based on these facts the investigation is now deemed closed by the Florida Department of Law Enforcement." This publication must openly question whether the State Attorney Office (SAO) has a conflict of interest in the Kilpatrick investigation. Prior to her October 2021 retirement - Captain Kilpatrick was in charge of the POPD's criminal investigations division. So, IF Kilpatrick was engaging in criminal activity involving a matter directly attached to the POPD - then her credibility within all other POPD criminal investigations could be called into question. Should Kilpatrick ever be criminally prosecuted for matters attached to the Fouts matter - we would imagine that the SAO would be duty bound to make Brady / Giglio notifications to numerous defense attorneys. Has the SAO concluded that they don't wish to properly investigate, or prosecute Kilpatrick - because doing so will open the Brady / Giglio "Pandora's Box"? |
Why didn't ASA Hutcheson request that FDLE SA Deardoff investigate further? Interestingly, ASA Hutcheson is currently on the "short list" for a gubernatorial appointment to the judicial bench (becoming a judge).

Maybe ASA Hutcheson realized that by opening this "Pandora's Box" - she may be "rocking the boat" regarding her ability to secure a judicial appointment? Unlike Sgt. Justin White - ASA Hutcheson doesn't seem to be a person that would place her career in jeopardy - in the defense of justice (Our OPINION). Sadly, in August 2021 - Sgt. White died of complications of COVID-19 - providing additional evidence to the maxim - "that only the good die young". Sgt. White died an honorable man - and law enforcement officer. While many will be "required" to refer to her as "your honor" - many will know differently. In the end - as these matters develop - we anticipate that Hutcheson's decision not to further investigate - will become a credibility stain to her public resume. In Walks Former Port Orange Police Officer Greg Cook For sometime now - this publication has watched former Port Orange Police Officer Greg Cook develop and argue the case against Kilpatrick (and others). Through tenacity & perseverance, Cook has expanded the initial allegations lodged against members of the POPD administration - including Kilpatrick. According to Cook's below listed email (and supportive records) - Cook alleges that public records attached to Fouts investigation are now missing. Apparently, these records came up "missing" around the same time frame of Kilpatrick's October 2021 retirement. We agree with Cook - IF public records are missing - the state attorney must investigate - AND if these records are attached to the Kilpatrick investigation - then we would argue that ASA Hutcheson should request that FDLE further investigate the allegations lodged against Kilpatrick. In closing - we are NOT fully aware of what is going on here... but there does appear to be plenty of smoke - AND with some honest investigative work - we are fairly sure that fire will be discovered..... just not sure who will get burnt by the flames. So - stand by to stand by...there is surely more to come of this..... |
