The Six Year Internal Cover-Up Starts To Fall Apart.


A recently completed (obtained April 2022) Port Orange Police Department (POPD) internal affairs investigation sustained - that immediately prior to her retirement (retired - October 2021) - former Police Captain Kimberly Kilpatrick deleted files from her assigned AND city owned electronic devices (computer, cellphone, other.). Many of these deleted, and forever lost files - were open to public inspection through Florida's public record laws.

While POPD Internal Affairs Investigator, Lt. Thomas Aiken "sustained" Kilpatrick's deletion of public records as merely violations of POPD policies. This publication sees a more sinister and malicious intent in Kilpatrick's deletion of these files.

This publication has concerns that Lt. Aiken's assignment to this investigation (deletion of public records) created an "investigative bias" - directly connected to his involvement in a past investigation (exploitation) on Kilpatrick (more on this later).

VolusiaExposed.Com forwards our suspicions that Kilpatrick deleted the records with criminal intent - in order to impede an on-going criminal investigation.

Available documentation verifies - that senior members of the POPD were aware of an open criminal investigation by the Daytona Beach Police Department (DBPD) - whereas Kilpatrick is at the very least "a person of interest", and possibly a full-fledged "criminal suspect". This DBPD investigation centers on the alleged financial exploitation of a disabled and retired POPD police detective.

These exploitation allegations have primarily been advanced by three individuals - POPD Sgt. Justin White (now deceased) - his spouse Cathleen White, and former POPD Officer Greg Cook. (supported by witness testimonies)

These "exploitation" allegations were "topics" within "investigations" conducted by the POPD (2019), as well as the Florida Department of Law Enforcement.(FDLE)(2018). HOWEVER, arguments have been made - that these "investigations" were heavily biased by loyalty and financial motivations. Further, these "investigations" failed to fully address the exploitation concerns that were presented within witness testimonies. (more on this later).

According to a June 18, 2021 email communication between former POPD Police Officer Greg Cook and FDLE Resident Agent-In-Charge Jason Kriegsman - the DBPD had an open investigation - into the financial exploitation of a disabled POPD detective.

The Kriegsman email was electronically carbon copied to senior management officials within Port Orange's government - including the POPD.(see below linked email communication)

Sources have confirmed that this DBPD investigation is still active (April 2022).

Confirmation has also been obtained - that unlike the POPD and FDLE "investigations" - the DBPD investigation is reviewing the full scope of the financial exploitation allegations.

These additional exploitation allegations were initially introduced within the 2018 FDLE investigation. One example of this is found within the testimony of Carmen Miller (2018) - the then supervisor of the City of Port Orange Victim's Advocate office. (see below audio testimony - Miller had concerns that funds were not being properly accounted for. From our perspective FDLE (and later POPD) failed to address these and similar allegations. Then again - RAC Kriegsman's email confirms that FDLE ONLY investigated the perjury & forgery allegations.).

FDLE's "Limp Dick" Investigation


It must be appreciated - that FDLE's 2018 "investigation" did not actually come to any investigative conclusions regarding whether Captain Kilpatrick had engaged in "forgery and perjury" - AND as per RAC Kriegsman's letter - FDLE also did not investigate the additional exploitation allegations.

In reality - the FDLE "investigation" was nothing more than a "evidence gathering expedition" - whereas FDLE forwarded their report to the local State Attorney office (SAO) for their review - to determine whether criminal charges were appropriate.

Some - with knowledge of the allegations - now allege - that the FDLE investigator intentionally "cherry picked" what evidence and testimony to highlight within his investigative report - in order to ensure that no criminal charges would be filed.

After being challenged regarding the veracity of their "investigation" - FDLE conducted a follow-up "review" of their "investigation" - issuing a November 8, 2019 memo. It is clear within this memo - that FDLE deferred to the State Attorney's Office (SAO) on whether criminal charges were appropriate against Captain Kilpatrick.

What is unclear - is whether the SAO was a willing scapegoat in the charging determination decision? Did the SAO understand that the FDLE investigation was in reality just a "dog and pony show" - played out to merely present the illusion that "FDLE had completed a comprehensive investigation into the criminal allegations against POPD Captain Kimberly Kilpatrick" (our OPINION). (see "conclusion section" from page 15 of the FDLE investigative report)

In direct response to a September 28, 2018 Daytona Beach News Journal (DBNJ) article regarding the FDLE investigation on Captain Kilpatrick - on October 2, 2018, then POPD Chief Thomas Grimaldi presented the completed FDLE investigative report to the City Council, as proof positive that Kilpatrick did not engage in criminal wrong doing.

Chief Grimaldi advised the City Council that the daughter of the disable police detective supports the innocence of Kilpatrick. The "problem" with that particular "advisement" - is that it is suspected (apparently inclusive to the DBPD investigation) that Kilpatrick and the daughter - may have conspired in the alleged exploitation.

In October 2018 - Police Chief Grimaldi was touting the FDLE investigation as the "be all - end all" determination - regarding whether Kilpatrick had exploited a fellow police officer - all while acting within her offical capacity (watch the above video).

HOWEVER - by January 2019 - Grimaldi's comfort level with the FDLE "limp dick" investigation must have dissipated - because, he assigned POPD Lt. Aiken to conduct an official internal affairs investigation on Kilpatrick - into these very same (and similar) allegations.

Did Lt. Aiken Have An Investigative Conflict Of Interest?


Now, imagine you are Lt. Aiken for a minute. You are "assigned" by your police chief to investigate whether Captain Kilpatrick committed "perjury" during an FDLE investigation - in which she was being investigated for allegedly committing "forgery and perjury". This being the very same FDLE investigation that your chief has already touted - to the mayor and city council - as basically proof positive that Kilpatrick is not only innocent - but the victim of "rumor mongering" - and unfair media coverage. (see above video --- see DBNJ article ===>> )

Also - if you (being Aiken) sustain the allegations against Kilpatrick - isn't that a "de facto" slam against the FDLE investigator - that he (the investigator) did not realize, OR did not care - that Kilpatrick was lying to him?

Come on folks - is it really a surprise that Aiken's 2019 "investigation" EXONERATED Kilpatrick?

NOW - think on this - Lt. Aiken was also the investigating officer in Kilpatrick's most recent (2022) internal affairs (IA) investigation regarding her deletion of public records from her city owned electronic devices.
Given Aiken's involvement within both the IAs (2019 / 2022) on Kilpatrick - he surely was - or should have been aware of FDLE RAC Kriegsman's 2021 letter stating that the DBPD was conducting their own exploitation investigation.

Aiken should have had a law enforcement officer's appreciation - that Kilpatrick may be a "person of interest" - or a down right suspect within the DBPD investigation.

POPD administrators, including Lt. Aiken - had to appreciate that these deleted files were certainly germane to the DBPD's open investigation.

Lt. Aiken had to further appreciate that these deleted files - could have contained evidence that may have called into question the validity of his 2019 investigation - including Kilpatrick's EXONERATION .

Aiken's law enforcement "spidey sense" should have concluded that Kilpatrick may have had a criminal motive in deleting those public records - in order to impede the DBPD criminal investigation.

In 2018 - and in response to *Sgt. White's email complaint to the Florida Attorney General's office alleging that POPD Captain Kilpatrick had assisted in the falsification of a beneficiary change on the disabled detective's life insurance policy - the FDLE opened an "investigation".

FDLE assigned Special Agent Christopher Deardoff to investigate the allegations that had been lodged against Captain Kilpatrick.

Deardoff's supervisor was none other than FDLE's Resident Agent In Charge Jason Kriegsman.

In January 2021 - this publication developed concerns that RAC Kriegsman had financial conflicts of interest regarding FDLE's corruption investigations within certain Central Florida police agencies.

On January 6, 2021 - VolusiaExposed.Com sent an "Open Letter" to FDLE's Public Information Officer Gretl Plessinger regarding our concerns with Kriegsman financial attachment to the "Valor Law Enforcement Group".

This publication developed concerns - that the business relationship between Kriegman's business entity and the BCSO - may have introduced an ethical conflict of interest - especially if it was ever determined (or covered-up) - that Edwards' death was related to any police training that the Valor Group had provided.

We (VolusiaExposed.Com) have similar concerns regarding whether FDLE (Kriegsman / Valor Group) had an ethical and financial conflict of interest regarding their "investigation" into the criminal allegations against Kilpatrick.

The Unspoken - QUID PRO QUO?


Rule # 1 in law enforcement ethics should be - never sell your badge or law enforcement authority - OR even present the appearance that your badge is for sale.

Do we know for a fact that RAC Kriegsman is exchanging his law enforcement authority for training contracts? No, in fairness - we don't. But we can fairly say - that Kriegsman's business ties (or potential ties) - with these agencies - that his FDLE office also investigates - does present an "unfavorable" appearance that there is an unspoken "Quid Pro Quo" understanding.

Coupling that "unfavorable" appearance with their (FDLE) "limp dick" Kilpatrick investigation - provides this publication with an honest opportunity to question the integrity of that investigation.



While FDLE "concluded" their 2018 investigation stating (see reference - directly above) "this presentation of facts is based on law enforcement interviews, civilian interviews, and collection of documents" - in truth, the FDLE NEVER expanded their investigation beyond the original allegations of "forgery and perjury". We known this to be a fact - because RAC Kriegsman advised former POPD Police Officer Greg Cook of that fact within their June 2021 email exchange.

During FDLE Special Agent Deardoff's investigation into the allegations against Kilpatrick - he did in fact interview several witnesses. We invite you to listen to the interviews of POPD's Victim's Advocate Director, Carmen Miller (2018) - and Cathleen White (2019) - and determine for yourself whether Deardoff FULLY investigated ALL of the allegations against Kilpatrick that were presented to him?

If so - we are left wondering - if law enforcement was responsible in any way, in the concealment of these alleged crimes - how does that affect the application of the statute of limitations?

Detective Fouts was left seriously injured - in a coma - and not expected to survive his injuries.

At this time - it was discovered that Fouts had not updated the beneficiaries on his departmental life insurance policy. As it stood - Fouts' former spouse was the policy's beneficiary - and not his surviving adult children.


David and Jennifer Fouts are pictured on a GoFundMe page established by
David Fouts' co-workers within the Port Orange Police Department.

Questions regarding the deposition of these GoFundMe funds are incorporated within the allegations against Kilpatrick.
Fortunately - Fouts survived his injuries. However, his injuries resulted in physical and mental disabilities that forced his early retirement from the POPD.

As stated by Chief Grimaldi (see above video) - one of Kilpatrick's tasks, as the liaison officer, was to facilitate the beneficiary change to Fouts life insurance policy prior to his expected death. As Grimaldi stated - Kilpatrick succeeded in changing the policy's beneficiaries.

The obvious "rub" with the beneficiary change - is how does a man in a coma - sign the paperwork necessary to make changes to his life insurance policy? However, additional financial exploitation allegations have been lodged against Kilpatrick - and are apparently being investigated by the Daytona Beach Police Department (DBPD).

Unfortunately - the DBPD investigation will most probably be impeded by Captain Kilpatrick destruction of public records - and potential evidence - just prior to her October 2021 retirement from the POPD. .... and so goes the local Florida justice system.....
