As was properly covered in a November 17, 2018 Daytona Beach News Journal article - Ormond Beach Police Officer Justin Pereira resigned after being served with a third misconduct suspension.

During our review of this incident - this publication found the Ormond Beach Police Department to be VERY transparent - and quick with honoring our request for records attached to this investigation.

This publication - within our August 23, 2018 article - covered Officer Pereira's past incident of misconduct, in which it was alleged that he ran unauthorized database checks. In that situation, we agreed with the OBPD assessment, that Ofc. Pereira did not violate any moral character standards (as defined in FAC 11B-27.0011).

However, regarding Pereira's most recent misconduct allegations - it would appear that OBPD suspected that Pereira may have violated a moral character standard (truthfulness in reports). Records seem to indicate that OBPD officials entered into a separation agreement with Pereira that precluded this suspected moral character violation from being fully investigated.

OUR OPINION & ADVISEMENT TO OBPD: Should your agency suspect a moral character violation (as defined in FAC 11B-27.0011) - your agency is duty bound to complete an internal affairs investigation (as defined in F.S. 943.1395(5) - regardless if the subject officer resigns / retires (suportive document: May 2010 FDLE / CJSTC Professional Compliance Bulletin information starts on bottom of page 3) - AND regardless of any separation agreement.
