SEX AND THE BADGE: A Sex Scandal Within The Volusia Sheriff's Office A Snap Shot Of Much Larger Concerns Within The VSO |

According to a local media account, as well as a recently completed Volusia Sheriff Office's (VSO) internal affairs report (click here or see below) - two male VSO deputies assigned to the agency's recently formed (2021) recruit training academy - both resigned while under investigation for having sex with a female recruit. Deputy Enmanuel Pena was a three and a half year veteran with VSO, and served as the Academy Coordinator - while Deputy Sean McRae had nearly ten years of service with the VSO - and was the academy's Emergency Vehicle Operations Course (EVOC) instructor. Daytona Beach News Journal July 27, 2023 Training deputies violated rules against having sex with a recruit, according to sheriff According to the VSO internal affairs report - Deputy Pena and Deputy McRae were unaware of each other's sexual tryst with the same female recruit (see page 6 - paragraph 3 & page 8 - last paragraph - - neither Pena or McRae made themselves available for official interviews during the internal investigation). The secrecy of the sexual trysts started to unwind when the subject female recruit advised another female recruit of the sexual encounters (see page 5 VSO IA report). The other female recruit reported the situation to VSO administrators. During the reporting recruit's internal affairs interview - she testified that Deputy Pena had requested that the subject recruit - invite her to join in on the sexual encounters. The reporting recruit "vehemently and repeatedly declined" the invitations. (see pages 6, 7, 8 of VSO IA report for particulars). A New Approach To Training As was stated earlier - the VSO Training Academy came into existence in 2021 due in large part to Sheriff Chitwood successfully securing State approval to operate his own law enforcement academy. Sheriff Chitwood had voiced the belief that the local college's law enforcement academy was failing to provide his deputies with the proper level of training. According to the below linked media article - Sheriff Chitwood expressed concerns that the college "was not meeting the needs of his agency when it came to subjects such as cultural diversity, implicit bias, de-escalating tense situations and the use of body cameras". Obviously - given the below listed VSO Internal Affairs findings - at least two VSO deputies experienced difficulties in maintaining proper "gun" control.
This publication opines that "horny" law enforcement officers are like "scurrying" cockroaches - if you see two of them - assume you have an infestation. In as far as the cockroaches - call an exterminator..... regarding the "me so horny" law enforcement officers - necessary terminations and agency wide remedial training is called for ... and much beyond the email advisement that Sheriff Chitwood sent to all of his deputies (see right of this page -->). |
It would also be extremely helpful - if law enforcement administrators would lead the way - exercising both "gun" control - and maintaining a strong grip on the "Truth".
"Bending" Of The Facts Sheriff Chitwood has a rather sordid history of providing false narratives. An excellent - and recent example of this - is when he alleged to the entire world - that two middle school children had fired military rounds from a AK-47 rifle at his deputies. Two independent law enforcement investigations (click here to review investigations) found no conclusive evidence in support of that allegation. Notice how Sheriff Chitwood states within his July 26, 2023 email to staff (see right of this page -->) that the inappropriate usage of influence and power can present the appearance of coercion, intimidation and / or favoritism. Sheriff Chitwood then states - "the only good news here is we found zero evidence of that". While Sheriff Chitwood states that "zero evidence" was found - the question arises - were they (VSO) actually looking for - or wanting to discover any evidence? This publication opines that Sheriff Chitwood is once again presenting another "false narrative". VolusiaExposed.Com found several examples within the VSO Internal Affairs (IA) report (see right of this page -->) of the appearances of coercion, intimidation and / or favoritism. Here are just a few referenced examples: 1. On pages 4 & 12 of the IA report - it states that the subject female recruit was the "class leader" - does that provide an appearance that the subject recruit was assigned that position because of her sexual relationships with two academy administrators? In fairness to the VSO administration - this publication reached out to the VSO public information office. Within an August 4, 2023 email (click here to review) - we inquired whether the recruit class leader was selected by her class of fellow recruits - OR whether that selection was made by VSO administrators - like Deputy Pena & McRae? As of the posting of this article - the VSO has not replied to our inquiry. Therefore - we now suggest that their (VSO) silence regarding this inquiry provides an additional appearance that there was inappropriate "favoritism" in the assignment of the "class leader". 2. Regarding the Ménage à trois invitation - the subject recruit continued to invite the second female recruit because she "didn't want to upset former Deputy Pena". Does that provide an appearance of coercion, intimidation and / or favoritism - and more importantly "sexual harassment" - see page 8 of the IA report? 3. Several other deputies - including the reporting recruit - voiced their concerns that the sexual relationships were inappropriate and unacceptable - see numerous references within the VSO IA report. We opine that those deputies' concerns - provided at the very least - the appearance that these sexual relationships were inappropriate - probably meeting the definition of sexual harassment. Even if the subject deputy did not feel victimized - the other recruits became vicarious victims of Deputies Pena's and McRae's sexual harassment. |

Within the above listed email from Sheriff Chitwood to his staff - he stated "Both instructor deputies resigned from the agency during the investigation. In spite of their resignation, we continued with the internal investigation." Sheriff Chitwood's statement implies that because of the deputies' resignations - he could have ceased the internal investigation into the two deputies. Once again - Sheriff Chitwood applies a false narrative - instead of the facts. |
The Florida "Criminal Justice Standards & Training Commission (CJSTC)" (a sub-branch within FDLE) requires that an investigation be completed - regardless whether the officer / deputy resigns during the investigation - should the employing agency suspect a violation of officer moral character standards (as defined in FAC 11B-27.0011). (see page 3 & 4 of the attached May 2010 CJSTC Professional Compliance Bulletin -->)

So congratulations Sheriff Chitwood - in spite of your deputies' resignations during the mandated internal affairs investigation - your agency "followed the law"(F.S. 943.1395(5) by completing the mandated internal investigation.
According to available CJSTC records (click here to review) the VSO sustained violations of the Florida's Officer Moral Character Standards against both deputies. And finally "kudos" to the VSO internal affairs unit - it only took three weeks to complete this "investigation" - usually VSO IA investigations can take numerous months - then again - usually VSO IA investigations are looking to secure evidence. This particular IA was done in a rather quick - "wham bam thank you ma'am" fashion ... sing it Dean Martin ... sing it my man !!!!!!! ..... stand by to stand by - there is surely more to come of this...... |
