Domestic Violence By Strangulation Earlier this month (November 2023) - this publication received word that the Lake Mary police department (Seminole County, Fl.) had arrested former Volusia Sheriff Lt. Justin Sawicki for domestic violence by strangulation. |
Recently, using Clerk of the Court records - this publication was able to confirm the arrest. (see right of page ==>>)
Upon contacting the Volusia Sheriff's Office (VSO) - they confirmed within a November 8, 2023 email response that Lt. Sawicki had resigned from the VSO a few weeks prior. Domestic Violence False Imprisonment Unfortunately, this particular incident was NOT Lt. Sawicki's "first rodeo" regarding allegations of domestic violence. As was highlighted within our October 26, 2021 article (see below link) the Winter Park Police Department in May 2021 documented a similar domestic violence incident against Sawicki alleging that he had falsely imprisoned his spouse. While Winter Park PD did not find enough probable cause to make an arrest* - the VSO has a statutory responsibility to internally investigate the incident (misconduct) for any violations of VSO policies - and much more importantly - for any violations of the Florida's Law Enforcement Officer Moral Character Standards (Florida Administrative Code 11B-27.0011 - including certain criminal violations - regardless whether criminal charges were filed - click here for particulars)**.
The VSO internal investigation only sustained VSO policy violations against Lt. Sawicki - no violations of moral character standards were sustained. Had moral character violations been sustained - Lt. Sawicki would have been referred to a Florida State Commission (CJSTC) for possible revocation of his law enforcement certification. * This publication "opines" that probable cause for an arrest did exist within the 2021 incident. We suspect that Winter Park PD opted not to arrest Lt. Sawicki as a professional favor to the VSO. ** This publication "opines" that the 2021 incident contained violations of the Florida Law Enforcement Officer Moral Character Standards. Think of the CJSTC like this - the CJSTC is to Florida's law enforcement and correctional officers - as the Florida Bar is to Florida's attorneys. The Florida Bar can disbar an attorney for misconduct - and the CJSTC can revoke an officer's law enforcement certification for violations of officer moral character standards. Without this State certification the officer can not be employed as a law enforcement or correctional officer. Should a law enforcement agency (like VSO) sustain a violation of the officer moral character standards - the agency is legally obligated to advise the CJSTC of the sustained violation - whereas the CJSTC can consider the officer for de-certification. If you are a person that has had life-time faith in law enforcement - AND you wish to keep your faith - then it is highly suggested that you now stop reading this article. Consider moving on to other things - so that you can remain in your blissful ignorant world - where, in your mind - Florida's law enforcement agencies operates with integrity. Okay - so you don't wish to live in ignorance - good. There is a "loophole" in the requirement of law enforcement agencies reporting misconduct to the CJSTC. This loophole exists by design - and not by error, and law enforcement agencies routinely exploit this loophole. As was stated earlier - CJSTC only requires law enforcement agencies to advise them of sustained "moral character violations" - as defined in Florida Administrative Code 11B-27.0011. Law enforcement agencies are NOT required to report violations of the law enforcement agencies' own internal policies. Most agencies will have an internal policy that states that officers should not engage in any conduct that would tend to place the agency in an unfavorable light. See page twenty-four (24) of Lt. Sawicki's 2021 internal affairs investigation - only VSO agency violations were sustained. During the subject officer's internal investigation - if the misconduct is sustained - it is ONLY sustained as an internal agency violation - to which the officer engaged in conduct that placed the agency in an unfavorable light. HOWEVER, many times this misconduct also meets the definition of a moral character violation which mandates a CJSTC notification. Regardless, the agency will simply chose to only recognize the misconduct as a internal policy violation - thereby circumventing the CJSTC reporting requirement. True to form - per the CJSTC 78 form filed in Lt. Sawicki's 2021 internal investigation - ONLY VSO policy violations were sustained. Per CJSTC rules - absent a sustained moral character violation - the CJSTC 78 form (click here to review blank form with instructions)*** need not be filed with CJSTC - but maintained solely within Sawicki's internal VSO file. ***"NOTE: DO NOT forward this form to the Criminal Justice Professionalism Program if the allegations have been sustained, but are violations of agency policy only, or other agency disposition has been found." Lt. Sawicki - having not suffered any moral character violations being sustained against him - would soon thereafter return to his law enforcement duties - where he would remain until his recent resignation (2023). According to online information (see right of page ==>) former Lt. Sawicki prior to his resignation was in charge of VSO's internal affairs division.
Given Lt. Sawicki's "commander" status within the VSO's internal affairs division he would have been keenly aware of how the agency manipulates the CJSTC reporting system regarding officer misconduct allegations. As the internal affairs commander - Sawicki would also know many of the agency's deep dark dirty secrets. There is an old adage - "knowledge is power". Therefore, we suspect that Sawicki used that "power" in quickly resolving his criminal prosecution. (read on) Sawicki's assignment with internal affairs - together with his inclusion within the below linked media article - in our opinion, pretty much personifies his "Golden Boy" status within the VSO. On July 18, 2021 - eighteen (18) year old Iyanna Rollins knew she had not committed any crime, when Volusia Sheriff Sgt. Chad Weaver rudely approached her and told her to "stop the fucking car". Ms. Rollins was indeed correct - she had done nothing wrong - in fact, the only one that was in the wrong was Sgt. Weaver - because, she knew she had done nothing wrong. Imagine if Ms. Everard had fought Officer Couzens as hard - she would probably be alive today. Ms. Rollins' trial is pending next month (December 2023). The local State Attorney is not even offering Ms. Rollins a plea deal (click here for additional details). While the police abused Ms. Everard by raping and killing her - our local police - with the assistance of the State Attorney's Office are "raping" Ms. Rollins by trying to take away her future and freedom.
