City of NSB losses court battle in denying website mananger access to city cell phone records

June 15, 2010 UPDATE: The City of New Smyrna Beach settles out with media website NSBSHADOW.COM for $20,000. Apparently NSB officials were attempting to over charge the website for public records. It was alleged that the "over charging" was an attempt by the city to discourage the website from obtaining the records.
Good job NSBSHADOW.COM,and let this serve as a warning to any other governments that might want to go down that same path.
We would like to congratulate the operator of the website -- NSBSHADOW.COM in their successful civil suit against the City of New Smyrna Beach. Apparently NSB officials were denying the public access to city employees taxpayer paid cell phone records.
Initially we had a similar problem in getting access to county email records - but thanks to the VCFS fighter union whom advised us that they were allow next to free access to review the county email server, we now routinely review county employee's emails.
