FDLE Investigation Clears Port Orange Police Captain Regarding Insurance Fraud Allegation |

According to a recent Daytona Beach News Journal article - a two-month Florida Department of Law Enforcement (FDLE) investigation has cleared a Port Orange PD police captain of insurance fraud. The insurance fraud allegation was lodged against Captain Kimberly Kilpatrick by another Port Orange PD officer. FDLE Special Agent Christopher Deardoff concluded that his investigative probe "did not produce evidence" supporting the allegation that Captain Kilpatrick altered another officer's life insurance documents. Former Port Orange Police Detective David Fouts was critically injured in an April 2016 motorcycle accident. The accident killed his spouse, Jennifer Fouts. The investigation was requested by Port Orange Police Chief Thomas Grimaldi after Port Orange Police Officer Justin White sent a letter to the Florida Attorney General's Office stating the Kilpatrick "forged" a life insurance policy for former Detective Fouts. |
According to Officer White's allegations - Detective Fouts was not expected to live - and his life insurance beneficiary was his ex-wife. Without a modification of the beneficiary - Fouts children would not be eligible to receive funds from the life insurance policy.
White advised FDLE that he had heard from secondary sources that Captain Kilpatrick wanted to modify the beneficiary. In the end - Fouts survived his injuries - and the FDLE investigation apparently could not find evidence to support Officer White's allegation. In our OPINION the FDLE investigation was a little light - and given the fact that Captain Kilpatrick was not relieved of her official duties pending the completion of the investigation - provides the impression that the investigative conclusion was already pre-determined.
