Local Judge Dismisses Criminal Prosecution Against NSB Social Activist, Cristina March Was Acting Within Her First Amendment Rights |
March 19, 2020 |
On March 17, 2020 - VolusiaExposed attended the Motion To Dismiss hearing attached to the misdemeanor criminal prosecution of social activist, Cristina March. On This Subject On June 14, 2019 - the Volusia County Sheriff's Office filed a an affidavit against Ms. March, charging her with cyber-stalking New Smyrna Beach (NSB) city employee Cayla Bartolucci. As covered within our December 2, 2019 article, "The Silencing Of Social Activist Cristina March", our publication explored, and questioned, whether city (NSB), county (Volusia), and state officials were misusing the criminal justice system, in an attempt to silence a government critic. During the dismissal hearing, and as this publication opined within our December 2, 2019 article, Judge Belle Schumann dismissed the criminal prosecution against Ms. March, ruling that March had the first amendment right to seek redress of her grievances with government officials. "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances". March was represented by Angela Lowrey of the local public defender's office. Hopefully, there is nothing more to report on this ...... at least at the criminal court level ......
