Depression: It's Not An Excuse


Circuit Court Judge Elizabeth Blackburn delivered a hard message to former Daytona Beach Police Officer Brandon Fox. Your depression can not be used to mitigate your criminal behavior - at least - not in her courtroom.

Last April (2022) Fox was arrested by his own agency (DBPD) for downloading / uploading / possessing electronic images of child porn.

Court records indicate - that last January (2023) Fox plead "nolo contendere" to all thirty plus counts of child porn possession that where eventually filed against him.

After the completion of today's (March 15, 2023) ninety (90) minute sentencing hearing (see videos to right of page -->) - Judge Blackburn adjudicated Fox guilty of all counts - sentencing him to twenty-five (25) year in prison - to be followed by forty-five (45) years of sexual offender probation.

In sentencing Fox - Judge Blackburn provided support for the paradigm that an individual, or entity, can hold one rogue officer accountable, while still maintaining a pro-law enforcement perspective.

During the hearing - the prosecutor called upon a DBPD police sergeant to testify - on how the DBPD became aware of Fox's criminal behavior.

Criminal defense attorney Aaron Delgado called upon Fox, as well as Fox's adult sister to testify.

Fox's sister advocated for a light sentence for her brother - based on his past public service to the community - including being a police officer within the DBPD.

Fox, as well as his sister alluded - that his criminality was connected to Fox's traumatization regarding the deaths of three (3) law enforcement colleagues - two by suicide, and one murdered in the line of duty - Officer Jason Raynor.

Both Fox and his sister articulated their shared concern that DBPD's Employee Assistant Program (EAP) failed to provide Fox with appropriate resources and counseling.

In the end - this publication tends to support DBPD Chief Jakari Young's statement (click here to review) - that "anyone found to be in violation of the law, including members of law enforcement who are sworn to protect and serve will be held accountable".

At the conclusion of the hearing - and as we (VolusiaExposed.Com) were exiting the courtroom - we overheard a discussion between the family and Mr. Delgado - that a Motion For Sentence Modification was being considered
